In 2002 our dispute resolution team provided adjudication services to a civil engineering specialist contractor working on a rail freight terminal in the United Kingdom. The problem was that the main contractor would not pay them for work agreed to be paid for on a re-measurable basis. The main contractor itself was executing the project on a design and build basis and had insufficient tender allowances for the work.
Our quantum team prepared a full re-measurement and valuation report and our dispute resolution team prepared a notice to seek adjudication. The dispute was then referred to adjudication and we provided party representatives and full advocacy services at the final hearing.
The adjudicator released an award favourable to our client and the main contractor paid the award in full.
