Description

The subject matter of the order is the collection and management of mixed and selectively collected municipal waste from the owners of the properties residing in the Gidle municipality up to 31.8.2021 in accordance with the rules of maintaining cleanliness and order in the Gidle municipality.
Within the framework of the order, the Contractor is obliged to collect and manage every amount of municipal waste from all the properties inhabited in the Gidle commune. It is also required to collect the waste which was placed next to the containers in bags when it did not fit into the containers and to empty additional private containers:3.2.1. Collection and management of each quantity of collected municipal waste from the area of the inhabited property (mixed bagged-container system), divided into the following types of waste:1) unsegregated (mixed) municipal waste - at least once a month, however, in the period from April to October: a) from a single-family development area - at least once every two weeks;b) from a multi-family development area - at least once a week;2) municipal waste collected in a selective way, divided into fractions:a) paper (consisting of paper waste, including cardboard, and paper packaging waste from cardboard) at a frequency preventing overfilling of the containers, however: - at least once every four months from single-family houses and multi-family buildings; b) glass (consisting of glass waste, including glass packaging waste) at a frequency preventing overfilling of the containers, however: - at least once every four months from single-family houses and multi-family buildings; c) glass (consisting of glass waste, including glass packaging waste) at a frequency preventing overfilling of the containers:- (c) plastics, multi-material packaging, metals (which includes plastic waste, including plastic packaging waste, multi-material packaging waste and metal waste) at a frequency that prevents overfilling:- at least once a month from single-family residential buildings and multi-family buildings;d) biodegradable waste, including green waste and biodegradable packaging, which has not been managed on its own in household composters - at least once a month, however, in the period from April to October: from the area of single-family buildings - at least once a week;3.2.2. Collection and management of each quantity of municipal waste collected and delivered by the residents of Gidle commune, from the point of selective collection of municipal waste (PSZOK), the following types of waste:1) furniture and other bulky waste;2) used tyres;3) used electrical and electronic equipment and used batteries and accumulators;4) outdated medicines and chemicals;5) construction and demolition waste constituting municipal waste;6) hazardous waste generated in the household;7) waste not eligible for medical waste generated in the household as a result of receiving medicinal products in the form of injections and monitoring the level of substances in blood, especially needles and syringes;3.2.3. collection and management of each quantity of collected out-of-date medicines from designated pharmacy points (Pharmacy in Gidlach, ul. Częstochowska 9, 97-540 Gidle; Pharmacy Point in Gidlach, ul. Wolności 1, 97-540 Gidle) - the Contractor is obliged to provide appropriate containers for the collection of outdated medicines and their systematic replenishment in case of such a need;3.2.4. organization of the selective collection point for municipal waste - in the place indicated by the Ordering Party, the Contractor will organize PSZOK within the period from the date of signing the contract, but not earlier than from September 1st 2020 to December 31st 2020. which will be equipped by the Contractor with appropriate bins and containers, adjusted in size to the existing needs, in order to ensure the proper segregation of the waste given away by the residents in accordance with the provisions of point 3.2.2, the resolution of the Municipal Council in Gidlach on the determination of the detailed manner and scope of the services of collecting municipal waste from the property owners and managing such waste, in exchange for the fee for municipal waste management paid by the property owners and the resolution of the Municipal Council in Gidlach on the adoption of the "Regulations for maintaining cleanliness and order in the area of Gidle municipality". The Contractor will be responsible for maintaining cleanliness and order in and around the area of the PSZOK and will provide a person who will operate the PSZOK during its working days and hours. PSZOK will accept waste from residents on the second and fourth Friday of each month from 12.00 to 15.00 pm, unless it is a public holiday, in which case PSZOK will be closed. The contractor shall be obliged to keep records of selectively collected waste delivered to PSZOK. From 1.1.2021 the Contractor shall ensure transportation (collection) and management of municipal waste collected at the point of selective collection of municipal waste (hereinafter referred to as PSZOK), maintained and serviced by the Contracting Authority on the plot No. 128 and 130 in Gidlach. The equipment and service of PSZOK from 1.1.2021 belongs to the Ordering Party. The service of collection and management of full containers will be performed no more often than twice a week after telephone or e-mail notification at the latest by the next working day. The Contractor shall be notified by an employee of PSZOK or by the Ordering Party about the need to collect waste. The Contractor is obliged to successively collect municipal waste from PSZOK, so as to ensure the possibility of continuous delivery of waste by the residents and to prevent overfilling of the containers in PSZOK. The waste that residents will deliver to PSZOK, the Contractor is obliged to transfer to the installation having mechanical-biological treatment of municipal waste, according to the hierarchy of waste handling. The Contractor is obliged to submit reports to the Contracting Authority in accordance with the provisions of point 3.3.11 of this ToR. 3.2.5. Equipping (under the agreement concluded with the Ordering Party) the owners of all inhabited properties with black containers for mixed waste and providing bags and containers for selectively collected waste. The quantities and volumes of the containers and bags for the inhabited real estate must be adjusted to the number of people inhabiting it, in accordance with the resolution of the Gidle Commune Council on the adoption of the "Rules of Maintaining Cleanliness and Order in the Gidle Commune" and information provided by the Ordering Party. Equipping the property with containers and the first equipment in bags should take place within the period from the date of signing the contract, however, not earlier than 1 September 2020, and then, on an ongoing basis, should be carried out throughout the entire duration of the contract. The containers during the execution of the order should be delivered within 5 working days from the date of acceptance. By 10.9.2020, the Contractor shall submit to the Ordering Party information on the quantities and type of containers and bags delivered to individual properties together with information on properties for which the containers have not been delivered, giving the reason for non-delivery. Waste containers should be new or used (in good technical condition - undamaged, clean and aesthetic), with a declaration of conformity issued by the manufacturer. Delivered bags for particular fractions of selectively collected municipal waste must differ in colour and have an indication of what kind of waste should be collected in them. That is: - blue with the inscription "Paper",- yellow with the inscription "Metals and plastics",- green with the inscription "Glass",- brown with the inscription "Bio".3.2.6. The Contractor until the third day of the month following the month in which the containers were delivered as required, starting from 3.10.2020, it shall be obliged to submit to the Purchaser a list of properties to which the containers were delivered in a given month, together with an indication of the quantity and capacity of the containers delivered, as well as information on properties to which the containers were not delivered, together with a justification of the reason for non-delivery (from the list provided by the Purchaser). 3.2.7 The Contractor shall be obliged to check the technical condition of the containers on an ongoing basis, repair or replace them if necessary. Possible claims for destruction of the containers due to the property owner's fault may be pursued by means of civil law. The claims may not concern the damage resulting from material wear and tear, cracks or damage that may occur during transport and loading. In the case of damage to the container, the Contractor is obliged to replace the damaged container with a technically efficient one within no more than 7 days from the date of knowledge about the damage. 3.2.8. If it is found that there is no container on the property or the amount of collected waste is greater than the capacity of the containers (the containers are overfilled and this situation is repeated at least 3 times during three consecutive waste collections), the Contractor is obliged to inform the Ordering Party about such situation within 7 days from the date of becoming aware of it. 3.3 Rules of waste collection, transport and management:3.3.1. The Contractor shall prepare (in consultation with the Contracting Authority) and deliver on the day following the signing of the contract to all the properties residing in Gidle municipality a schedule of waste collection for the period from the date of signing the contract, but not earlier than 1.9.2020 to 31.8.2021. (number of properties to which the schedule should be delivered - according to the data contained in point 3.5), in the form of leaflets placed in letterboxes or handed over "at hand" and by displaying on generally available notice boards in particular locations - leaflets in the form of black and white printouts, minimum format: A5 (the electronic version of the leaflet will be provided by the Contractor to the Contracting Authority for publication on the website).3.3.2. Waste should be collected from Monday to Friday between 7.00 a.m. and 6.00 p.m., in particular locations on the same day of the week, if the set day of collection falls on a statutory holiday, then the collection of waste should take place on the first working day following the statutory holiday.3.3.3 The collection of waste shall be carried out from the containers issued by the owners outside the property (by the access road) or from pergolas in the case of multi-family buildings. During waste collection, it will not be allowed to mix selectively collected waste with unsegregated waste. The Contractor shall also be obliged to collect waste lying in bulk next to the emptied containers and to bring to order the adjacent area, i.e. the area within a radius of up to 2 meters, polluted as a result of overfilling of the containers - this obligation shall be performed immediately after the containers have been emptied.3.3.4. Collection of waste from such properties shall be carried out using light, small-sized equipment in front of the entrance gates to the properties.3.3.5..3.7 The Contractor shall transfer the collected waste from the property owners to the waste recovery and neutralisation installation (in accordance with the waste hierarchy referred to in Art. 17 and the proximity principle defined in Art. 20 of the Waste Act of 14 December 2012 - Journal of Laws of 2019, item 701 as amended), and in the case of mixed waste, green waste and residues from sorting of municipal waste into a municipal installation in accordance with the waste management plan of the Łódź Province, in accordance with the principles set out in the Act of 13 September 1996 on Maintaining Cleanliness and Order in Communes.3.3.8. In emergency situations (such as impassability or road closures), when it is not possible to provide the service in accordance with the schedule, the method and date of waste collection will be each time agreed between the Principal and the Contractor and may consist, in particular, in the designation of substitute waste collection places by the property owners and other dates of waste collection - such a method of performance under the contract may be performed only upon prior approval of the Principal.3.3.3.9 The Contractor shall indicate in the offer form the municipal waste processing installations to which it will transfer the collected waste.3.3.10 The Contractor shall be obliged to monitor the residents' compliance with the obligation to segregate municipal waste, if it is found that the property owner, despite the obligation, does not segregate the waste, then the Contractor shall collect it as mixed and: - informs the owner of the property about badly segregated waste by sticking a warning sticker on the container, e.g. in the form of a self-adhesive card,- prepares photographic documentation of the event and a protocol containing the date, town and number of the property, on which incorrect segregation was found,- immediately informs the Ordering Party about this fact, providing the prepared documentation.Avoidance of the obligation to notify the Gidle Commune Office of the information concerning the irregularities in the way of waste segregation will constitute a breach of contract. The Ordering Party does not allow the collection of municipal waste ordered by the Ordering Party jointly on the same dates with any other municipal waste from the owners of properties not residing in the Gidle Commune. The Contracting Authority does not allow the collection of municipal waste ordered by the Contracting Authority jointly on the same dates with any other municipal waste from property owners residing in the municipality of Gidle who conduct business activity and are required to have separate waste collection agreements in connection with their activity.3.3.11. The Economic Operator shall be obliged to prepare and provide the Contracting Authority with reporting documentation on the course of the execution of the subject of the contract in the form of: a) a report as of 10 September 2020. a) a report as of September 10, 2020 on the quantity and type of containers handed over to the owners of particular properties and monthly reports on the quantity and types of containers handed over in a given month together with current information on the quantity and types of containers located at particular properties; b) monthly reports containing information on the quantity (weight) of collected municipal waste and the manner of its management - indicating the installation to which it was handed over; c) waste handover cards, which shall specify the date, code, weight and type of waste handed over. Cards must indicate that the transferred waste comes from the Gidle commune. Cards will constitute an attachment to the invoice issued by the Contractor; d) reports referred to in art. d) reports referred to in art. 9n and 9 of the Act on Maintaining and Order in Municipalities; e) monthly information on the number of properties from which municipal waste was not collected, giving the reason for not collecting the waste; f) monthly information on the amount (weight) and fractions of delivered waste to the PSZOK by residents of Gidle municipality; g) other information, held by the Economic Operator, on waste neutralization and segregation, if during the execution of the order the Contracting Authority will impose such an obligation. 3.3.12. The Economic Operator shall be obliged to obtain: 1.a) the level of limitation of the mass of biodegradable municipal waste transferred for storage in the individual years in accordance with the Ordinance of the Minister of the Environment of December 15, 2017 on the level of limitations for storage of the mass of biodegradable municipal waste;1.b) the level of recycling and preparation for reuse of the following fractions of municipal waste: paper, metals, plastics and glass in the individual years in accordance with the Ordinance of the Minister of the Environment of December 14, 2016. 1.c) the level of recycling, preparation for reuse and recovery by other methods of certain fractions of municipal waste;1.c) the level of recycling, preparation for reuse and recovery by other methods of non-hazardous construction and demolition waste in particular years in accordance with the Regulation of the Minister of Environment of 14 December 2016 on recycling levels, preparation for reuse and recovery by other methods of certain fractions of municipal waste. 3.4 Other requirements for the Contractor:3.4.1. The Contractor shall be obliged to collect municipal waste continuously, within the deadlines resulting from the adopted collection schedule, regardless of weather conditions.3.4.2. The Contractor shall perform the service with vehicles in appropriate technical and sanitary condition, with current technical tests marked with the logo and basic contact details of the company, and meeting the requirements of the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for collection of municipal waste from property owners (Journal of Laws of 2013 item 122). 3.4.3. At the request of the Ordering Party, the Contractor will be obliged to document the performance of the service by presenting a record from GPS devices. 3.4.4. The Contractor shall be fully liable for damages caused by him during the execution of the subject of the contract. 3.4.5. The Contractor shall be obliged to weigh all collected municipal waste on a certified scale and keep the documentation of measurements for the Ordering Party's inspection for the period of order execution. 3.4.6. The Contractor shall be obliged to have a storage and transport base located in the area of Gidle municipality or not more than 60 km from the borders of Gidle municipality, in the area to which he has a legal title, equipped in accordance with the requirements contained in § 2 paragraphs 2-4 of the Regulation of the Minister of Environment of 11 January 2013 on detailed requirements for collection of municipal waste from property owners (Journal of Laws of 2013, item 122). 3.4.7. The Contractor shall collect waste from properties with difficult access, i.e. far away from the main traffic glasses to which ground roads lead. The Ordering Party shall not be liable for damages caused by the Contractor during the performance of the subject of the order. The Contractor shall be responsible for damages to the Principal's property or third parties caused by waste collection. The Contractor shall be obliged to observe both the currently binding legal regulations and follow possible changes in them as well as newly introduced legal regulations. Other information concerning OPZ is presented in chapter 3 of the ToR.
