Description

The subject matter of the contract is the collection, transport and delivery for processing of waste from military units and institutions located within the local jurisdiction of the Regional Branch of the Military Property Agency in Kraków: 15 01 07, 15 01 10*, 15 02 02*, 15 02 03, 16 01 19, 16 01 99, 19 12 01 with a total weight of 9535.25 kg;Part 2 - Collection, transport and handing over for processing of waste with the following codes: 16 01 13*, 16 01 14*, 16 01 15, 16 07 08* with a total weight of 7355.40 kg.Part 3 - Collection, transport and handing over for treatment of waste with code: 17 01 81 with a total weight of 20000.00 kg.Type of activities related to the execution of the order, which concern the requirement to employ on the basis of an employment relationship by the contractor or subcontractor, persons performing activities during the execution of the order: activities involving the loading and transport of waste, related to the execution of the subject matter of the order, the performance of which involves the performance of work in the manner specified in Article 22 § 1 of the Labour Code Act.
Pursuant to art. 121 item. 1 of the Act of 11 September 2019. Public Procurement Law (Journal of Laws of 2019, item 2019 as amended), the Contracting Authority reserves the obligation for the Contractor to personally execute the key part of the contract, i.e. the waste collection service.The Contracting Authority provides for a basic contract and within 3 years from the day of awarding the basic contract a possibility to award contracts to the existing Contractor, referred to in art. 214 item 1 point 7 of the Act, consisting in repetition of the services provided by the Contractor. The Contracting Authority provides for a base contract and a possibility to award contracts referred to in art. 214 sec. 1 item 7 of the Act to an existing Economic Operator over a period of 3 years from the award of the base contract. The Contracting Authority guarantees that the base contract will be awarded, however, from awarding the contract referred to in art. 214 sec. 1 item 7 of the Act the Contracting Authority may not award the contract. The subject matter of the contract and a description of the service provision method:1. The subject matter of the contract is a service of collection, transport and handing over for processing of waste from military units and institutions located within the local jurisdiction of the Regional Branch in Kraków, weighing 9,535.25 kg (listed in Appendix no. 1a) with the following waste codes: 15 01 07, 15 01 10*, 15 02 02*, 15 02 03, 16 01 19, 16 01 99, 19 12 01.The Contracting Authority permits the Contractor who collects waste from the place indicated by the Contracting Authority to process the collected waste on his own, without handing it over for processing to another entity.2A detailed list of waste (by waste code) is as follows Waste code Quantity [kg]1 --- 15 01 07 --- 554,002 --- 15 01 10* --- 5 517,503 --- 15 02 02* --- 50,004 --- 15 02 03 --- 1 500,005 --- 16 01 19 --- 206,106 --- 16 01 99 --- 80,007 --- 19 12 01 --- 1 627,65Total quantity: --- 9 535,253. CPV - 90500000 - 2 waste services; CPV - 90512000 - 9 waste transport services.4 .The weight, composition, waste codes and the places of waste collection are presented in appendix 1a to the Description of the Object of Order.5 The weight of waste collected by the Contractor may not exceed the weight of waste specified by the Ordering Party.6 The weight of waste specified in appendix 1a to the Description of the Object of Order may be decreased by up to 25%.7 The specified weight of waste is net weight.8 The waste is stored in the manner specified by military units and institutions. The waste storage place is described in column no. 5 - "Waste storage place / method of storage" of appendix no. 1a. The Contractor is obliged to secure on his own the packaging for transport.9. Weighing, loading and transport will be carried out at the expense of the Contractor and by his forces.10. On the basis of statements of military units and institutions transferring waste it is concluded that the waste listed in Appendix No. 1a cannot be prepared for reuse within the meaning of Article 3. par. 1 pt. The subject matter of the order shall be executed in accordance with applicable law, in particular with: a) Waste Act of 14 December 2012 (Journal of Laws of 2020, item 797 as amended),b) Act of 27 April 2001 - Environmental Protection Law (Journal of Laws of 2020, item 797 as amended). Environmental Protection Law (Journal of Laws of 2020, item 1219 as amended),c) Regulation of the Minister of Climate of 2 January 2020 on the waste catalogue (Journal of Laws of 2020, item 10),d) Regulation of the Minister of Environment of 7 October 2016 on detailed requirements for waste transport (Journal of Laws of 2016, item 1742 as amended),e) Act of 23 January 2020 on amending the Act on waste and certain other acts (Journal of Laws of 2020, item 150),f) the Act of 19 August 2011 on the carriage of dangerous goods (Journal of Laws 2020, item 154) and the European Agreement concerning the international carriage of dangerous goods by road (ADR) (Journal of Laws 2017, item 1119 as amended).12. The Contractor shall be obliged to transfer waste to an entity with the appropriate waste processing authorisations, as required by the Act of 14 December 2012 on waste (Journal of Laws 2020, item 797 as amended) and the Act of 27 April 2001. Environmental Protection Law (Journal of Laws of 2020, item 1219 as amended) and the Regulation of the Minister of Climate of 2 January 2020 on the catalogue of waste (Journal of Laws of 2020, item 10) or to process waste on their own, if the Contractor holds the relevant rights referred to above.13. The Contracting Authority shall make it possible for the Contractor to inspect the waste. For this purpose, the Contractor is obliged to agree the date and time, at least 3 days in advance, with: - Mr. Bartłomiej Baziak (e-mail: b.baziak@amw.com.pl, tel. 12 211 41 43) or- Ms. Monika Żuwałą-Czyż (e-mail: m.zuwala@amw.com.pl, tel. 12 211 40 43)At the same time the Contracting Authority informs, that due to force majeure and the declaration of the state of epidemic emergency by the Minister of Health in the Republic of Poland, and then the state of epidemics, the site inspection will be held on the following conditions:1.Contractors will not be allowed to participate in the site inspection at a time other than the date and time appointed for them.14. Before signing the contract the Contracting Authority will provide the selected Economic Operator with telephone numbers of the persons responsible for the delivery of waste from military units and institutions.Contracts referred to in art. 214 item 1 point 7 of the Act Contracts referred to in art. 214 par. 1 item 7 of the Act: 1st Contracting Authority provides for the possibility to award contracts consisting in the repetition of similar services consistent with the subject matter of the base contract, referred to in art. 214 par. 1 item 7 of the Act, with a total value no greater than for: - part 1 - up to 100% of the base contract.2 Contracts consisting in the repetition of similar services will be awarded if there is a justified need to extend the base contract and funding is available for this purpose.3 .The amount of remuneration for similar contracts shall be determined according to the same rules as for the remuneration for the base contract.4. The conditions under which such contracts will be awarded shall not be more extensive than those defined in the base contract, and in particular: - the waste codes shall not differ from the list of waste codes provided by the Principal in the base contract; - the weight of waste shall not exceed that specified by the Principal in the base contract; Lp. The Contractor shall be obliged to transfer waste to an entity with the appropriate waste processing authorisations, as required by the Act of 14 December 2012 on waste (Journal of Laws 2020, item 797 as amended) and the Act of 27 April 2001.
