Description

The subject of the contract are services of towing and parking vehicles secured for procedural purposes (not covered by the disposition of art. 50a sec. 1 and art. 130a sec. 4 of the Act of 20 June 1997 on Road Traffic Law, i.e. consolidated text in Dz. U. of 20 June 1997. 2020, item 110 and 284, as amended), protection of property due to undertaking official actions by the police and towing of official vehicles for KMP in Łódź, ul. Sienkiewicza 28/30.2. Pursuant to art. 24aa item 1 of the Public Procurement Law, the Contracting Authority shall first evaluate the tenders and then examine whether the Economic Operator whose tender has been evaluated as the most advantageous one is not excluded and meets the conditions for participation in the procedure.3Pursuant to art. 93 item 1a of the Public Procurement Law, the Contracting Authority reserves the right to cancel the contract award procedure if the funds which the Contracting Authority intends to allocate to finance the whole or part of the contract are not allocated to them.

Sienkiewicza 28/30.2. A detailed description of the subject matter is contained in appendix no. 2 to the ToR, while detailed terms and conditions of performance are specified in appendix no. 7 to the ToR - model contract.3The anticipated number of tows (transport) and number of days/days of parking included in Annex no. 2 to the ToR - Description of the subject matter of the contract is the basis for calculating the tender price, and a smaller number of services than anticipated cannot constitute claims from the Contractor. In the period of three years the Contracting Authority shall provide the following number of services: - anticipated number of tows up to 3.5 t - 1 800,- anticipated number of days of vehicle storage at the car park up to 3.5 t - 18 000,- anticipated number of tows above the level of the contract. 3,5 t - 45,- expected number of days of storing vehicles at the car park above 3,5 t - 900.4. The provision of services within the scope of this contract will be in accordance with the current needs of the contracting entity, therefore the Contracting Authority reserves the right to amend the contract in the scope of the number of services specified in Annex no. 2 in the event that it differs from the actual needs of the contracting entity.5The settlement will take place on the basis of the services actually provided according to the unit prices in accordance with the submitted tender.6 The Contracting Authority reserves the right to verify the information indicated in Annex 2 to the ToR - Description of the subject matter of the contract and Annex 4 to the ToR - List of equipment and description of the car park by inspecting the car park and the equipment indicated in the above mentioned Annexes. If, as a result of the on-site inspection, it turns out that the information provided by the Economic Operator in the documentation of the procedure is inconsistent with the actual state of affairs, the Economic Operator shall be excluded from the procedure and his offer shall be rejected.7 Due to a possible possibility of using reloading works and additional services (e.g. crane work), the gross value of the contract shall be increased by 20% of the gross amount given in the offer for towing.
