The subject of the contract is the delivery of consumables for printers and faxes to the Ordering Party's registered office, 108/112 Lutomierska Street in Łódź, POLAND.2 The delivery also includes transport and contribution to the warehouse of the Communications and Information Technology Department (rooms in the basement of the building at 108/112 Lutomierska Street, Łódź, POLAND).3 The quantities of the ordered assortment presented in Appendix 2 to the ToR are estimated quantities used to calculate the price of the offer, which may change during the contract execution. The final number of particular items will result from the actual needs of the Contracting Authority and the budgetary means at his disposal, and in case of smaller needs, they cannot constitute grounds for claims from the Contractor.4 The Contractor will execute the order at unit prices included in the offer.5 The Contracting Authority reserves the right to purchase up to 100% of the original products.6If the assortment does not exist (or the Contractor does not submit a proposal), the price of the original product should be entered in the equivalent product for the price of that product.7 If the assortment listed in the assortment and price Form - Appendix No. 2 to the ToR - is covered by a patent of the device manufacturer, the price of the original product should be entered in the item for the equivalent product. Verification of the items covered by the patent rests with the Contractor.8. Pursuant to art. 24aa sec. 1 of the PPL, the Contracting Authority shall first evaluate the bids and then examine whether the Economic Operator whose tender was assessed as the most advantageous is not subject to exclusion and meets the conditions of participation in the procedure.
