Nature of Requirements:
1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the requirement
2.1 The Department of O Division RCMP-GRC Emergency Response Team (ERT) has a requirement for the supply of:
4 x 15 meter high strength wire ladders and additional attachment accessories
3 x 8 inch titanium dual hook and additional attachment accessories
4 x 15 meter light weight telescopic windup pole and additional attachment accessories
1 x 7 meter high strength wire ladder and additional attachment accessories
1 x 5 inch titanium single hook and additional attachment accessories
2.2 In accordance with ERT marine operations these items must be light weight and durable.
The titanium hooks must be at least grade 6AI-4V (Grade 5) titanium and be able to hold at least 2200lbs/1,000kg, these hooks must exceed or be equivalent to the REBS HK-TI-D-8.0IN-HLK.
The high strength wire ladders must have a heavy grip diamond knurled-rung and flexible stainless steel wires, these ladders must exceed or be equivalent to the REBS WL-15.0M--15M WIRELADDER.
The pole must be light weight, have windup telescopic capability to at least 49 feet, this pole must exceed or be equivalent to the REBS WND-TPCF-15.0M--REBS 15M TELESCOPIC WINDUP POLE SYSTEM
All goods must be received by March 2020.
3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
3.1 The supplier must identify the ability to produce and deliver products that meets or exceeds that mentioned in section 2.1 and 2.2.
3.2 The supplier must also identify the ability to repair all supplied products by means of either service technician or supply parts for the products mentioned in section 2.1 and 2.2
4. Applicability of the trade agreement(s) to the procurement
This procurement is subject to the following trade agreements: the Canadian Free Trade Agreement (CFTA)
5. Justification for the Pre-Identified Supplier
5.1 Atlas Devices, the authorized dealer for REBS as been identified as the best pre-identified supplier for the above noted goods.
5.2 REBS, a division of HENRIKSEN is a world leader with regards to ascending and descending methods for tactical applications. Atlas Devices has been identified as the sole North American distributor for Canada and the USA.
5.3 Atlas Devices is able to supply all the required REBS equipment and accessories needed by the RCMP to outfit their vessels and assaulters with the gear needed to respond to armed ship boardings and counter terrorism operation in the marine environment.
5.4 Currently, REBS is the sole North American supplier that can supply
5.5 Atlas Devices can provide any repairs or servicing required to ensure minimal operational down time.
6. Government Contracts Regulations Exception
The following exception to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work").
7. Exclusions and/or Limited Tendering Reasons
The following exclusion(s) and/or limited tendering reasons are invoked under the (section of the trade agreement(s) specified):
Canadian Free Trade Agreement (CFTA) Article(s) 513 (b):
(ii) the protection of patents, copyrights, or other exclusive rights;
(iii) due to an absence of competition for technical reasons;
(v) to ensure compatibility with existing goods, or to maintain specialized goods that must be maintained by the manufacturer of those goods or its representative;
8. Period of the proposed contract or delivery date All goods must be delivered on or before 31 March 2020.

10. Suppliers' right to submit a statement of capabilities
Suppliers who consider themselves fully qualified and available to provide the goods described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
11. Closing date for a submission of a statement of capabilities
The closing date and time for accepting statements of capabilities is indicated in the posting.

You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any procurement.
Documents may be submitted in either official language of Canada.
