Description

BVG, as sector contracting authority, invites tenders for the calendar year 2023 and optionally for the calendar year 2024 for rail replacement services (SEV) with buses provided by the AG in local public transport, which the contractor organizes and carries out independently. The service shall be provided in five separate but equivalent lots. There is no lot restriction, i.e. a bidder may bid for one or up to 5 lots.A bid for one lot shall be submitted in such a way that the bidder submits a bid for one of five (quantity) lots; a concrete specification of a specific lot number shall not be made.A bid for several lots shall be submitted in such a way that a bidder specifies for how many (quantity) lots he submits a bid. We draw the attention of the bidders to the fact that the forms of the AG provide for a determination of the lot number in deviation from this. Nevertheless, the AG will include the bid of a bidder entered in the bid form under lot number 1 in the evaluation for lots 2, 3, 4 or 5 if the bid is not already intended for the award of a lot. In the event of a tie, the award shall be made to the bid with the lower bid price.The number of lots for which a bidder has bid shall be taken into account in the award decision, i.e. a bidder shall be awarded the maximum number of lots for which it has bid or the maximum number of lots for which it has been awarded the contract. on the maximum number of lots for which the bidder is eligible.ATTENTION: BVG has already tendered six lots of its requirement for SEV services (see notices in the OJEU No. 2022/S121-345441 and No. 2022/S 155-445922). With the present invitation to tender, five further lots of a uniform procurement requirement of BVG (i.e. a uniform public contract, subdivided into a total of eleven lots) are advertised.With regard to the requirements of suitability, the two lots already advertised are to be taken into account (cf. Section III.1.1. to III.1.3).
There is a monthly requirement of approx. 2,000 h (operating hours) for rail replacement services, for a total period of 10 months. There will be approx. 4 rotations per day with approx. 17 hours per rotation. The rotations will start at approx. 05.00 hrs and end at approx. 22.00 hrs. Each round trip will start and end at one of the AG's depots. 20,000 operating hours will be required during the service period (10 months). The operating hours stated are a guide value. The Client shall call for at least18,000 operating hours for the performance period March 2023 - December 2023 (10 months) and no more than 22,000 operating hours.The Contractor shall not be entitled to call for a minimum number of operating hours per month, but shall be entitled to remuneration for at least 18,000 operating hours in the performance period March 2023 - December 2023 (take-or-pay).The Client shall call for the driving performance to be provided in each case no later than3 weeks in advance and shall specify the details of the driving performance at the same time. If the Client is unable to use the Contractor's requested mileage for rail replacement services, in particular due to unforeseeable changes or internal operational processes, the Client may also use the requested mileage for other SEV services or the Client's regular services.
