Description

The subject of the order is "Purchase of e-services for the St. Barbara Provincial Specialist Hospital No. 5 in Sosnowiec within the framework of the project entitled: "eCareMed - development of digital medical services at the St. Barbara Provincial Specialist Hospital No. 5 in Sosnowiec", divided into tasks: 1.1. Task No. 1: Delivery of software with integration for e-services. 1.2. Task No. 2: Integration of HIS with Cato.
4.Detailed information and the manner of execution of the contract are contained in the following attachments to the SWZ:a) Attachment No. 1 to the SWZ - bid form;b) Attachment No. 2 to the SWZ - JEDZ;c) Attachment No. 3 to the SWZ - statement on affiliation or non-affiliation to the same capital group;d) Attachment No. 4 to the SWZ - statement of the Economic Operator on the validity of the information contained in the statement referred to in Art. 125 par. 1 of the PPL;e) Appendix No. 5 to the SWZ - draft provisions of the Contract Agreement;f) Appendix No. 6 to the SWZ - description of the subject matter of the contract;g) Appendix No. 7 to the SWZ - statement for Economic Operators applying jointly for the award of the contract;h) Appendix No. 8 to the SWZ - statement of the Economic Operator/Contractors applying jointly for the award of the contract regarding exclusion due to sanctions imposed on the Russian Federation;5. The Contracting Authority requires that the subject matter of the contract be delivered to its premises within a maximum period of 90 calendar days. The Contractor shall indicate in the bid form the period within which he will deliver the subject of the contract. If the Contractor fails to indicate the period of performance (delivery date) and/or indicates a period of performance not in accordance with the accepted rules set forth in Section XIX of the SWZ, the Contracting Authority informs that the Contractor's bid will be rejected as inconsistent with the terms of the contract pursuant to Article 226 (1) item. 5 of the PPL. The completion date is the second criterion for selection of the most advantageous bid.6Detailed information and method of execution of the contract is contained in the description of the subject of the contract (OPZ, constituting Appendix No. 6 to the SWZ) and the draft provisions of the contract (Appendix No. 5 to the SWZ).7. If it follows from the attached documentation that the Ordering Party described materials, equipment, technologies with the indication of specific trademarks, patents or origin, source or specific process that characterizes the products or services provided by a particular Contractor, they should be treated as examples and the Ordering Party allows the Contractor to use solutions equivalent to those indicated by the Ordering Party, provided that they have at least the same or better technical and functional parameters and do not lower the specified standards.8.Pursuant to Article 101(4) of the PPL Act, any reference in the description of the subject matter of the contract to standards, European technical evaluations, approvals, technical specifications and technical reference systems referred to in Article 104(1)(2) and (3) of the PPL Act, the Contracting Authority shall allow equivalent solutions. This should be read in such a way that each time such reference is accompanied by the words "or equivalent".9. Contractors may submit bids containing solutions equivalent to the subject matter of the contract as presented in the SWZ - in accordance with art. 101 (4), (5) and (6) of the PPL Act, but they are obliged to prove that the solutions they offer meet the requirements specified by the Contracting Authority. Equivalence in terms of technical, utility and operational parameters is to ensure, in particular, that the parameters are not worse than those assumed in this SWZ.10. In the case of offering equivalent solutions, the Contractor must, together with the offer form, present the offered solution and attach evidence documenting the basic technical parameters and comparative analysis, from which it will be unequivocally clear that they are fully equivalent to the devices, materials, technologies indicated by the Contracting Authority in the documentation of the proceedings. The proposed equivalent solution should have the legally required certificates, certifications, approvals, and meet the requirements specified in the documentation of the proceedings.11. The Employer requires that the Contractor, in the course of delivery, take into account the execution of the subject matter of the contract so as not to create restrictions on accessibility to them by persons with disabilities, in accordance with Article 100 of the Act of 11.09.2019 Public Procurement Law and the Act of 19.07.2019 on ensuring accessibility to persons....
