Subject of the contract: collection and management of the entire mass of solid municipal waste handed over by the owners of properties where residents live and from properties where residents live in part and residents do not live in part and where municipal waste is produced, in the Municipality of Zakopane, both mixed municipal waste and waste collected in a selective manner, in particular m.including: paper, metals, plastics, glass, multi-material packaging and biodegradable municipal waste, including biodegradable packaging waste and green waste, as well as other waste generated on real estate, in the period from signing the agreement to 31.12.2019. 3.1 The notion of real estate used in the following should be understood as real estate on which residents reside and real estate on which residents reside in part and residents do not reside in part and on which municipal waste is produced. 3.2 As at the date of signing the agreement, the Contractor shall receive from the Contracting Authority a detailed list of properties from which municipal waste will be collected - 9 176 waste collection points as at 31.7.2018 - properties where residents live and properties where residents live in part and residents do not live in part and where municipal waste is produced. 3.3 The number of properties from which waste will be collected may change as a result of the declarations submitted on the amount of municipal waste management fee. 3.4 The presented list of real estates covered by the contract, constituting attachment No. 2 to the ToR, will be supplemented on an ongoing basis in accordance with the declarations submitted on the amount of municipal waste management fee: 3.5 The contract does not cover the collection of waste from the Tatra National Park. 3.6 The collection of municipal waste from urban street baskets shall not be covered by this Agreement. 3.7 The operation of the Municipal Waste Collection Point shall not be covered by this Agreement. 3.8 Total quantity of municipal waste expected to be collected and managed during the term of the contract: - unsorted (mixed) municipal waste 8 400 Mg, - separately collected municipal waste 2 145 Mg. 3.9 The indicated quantities of municipal waste are an approximate value calculated on the basis of the quantities of waste collected in previous years (taking into account the expected increase in the amount of waste). The Ordering Party reserves the right to reduce or increase the quantity of waste delivered in relation to the calculations from previous years, depending on the actual needs, without the Contractor's right to claim compensation on this account. 3.10. Additional information on the quantity of waste collected from the area of the Municipality of Zakopane can be found on the website http://bip.zakopane.eu/gospodarka-odpadami-komunalnymi-2017-1.3.11. The Ordering Party does not guarantee the aforementioned quantity of municipal waste during the term of the contract. 3.12. The Contractor shall take into account the change in the waste stream occurring during the year due to seasonal tourist traffic in the area of the City of Zakopane and due to the city development process - newly built facilities. 3.13. The area of the commune (excluding the TPN area) amounts to approx. 3 560 ha at the level of land level from the order of ≈750 m. altitude (Olcza) to the order of 1 126 m. a.s.l. (Gubałówka), TPN area of 4 921 ha.): Quality standards, referred to in Art. 91 par. 2a of the PPL Act, related to all essential features of the subject of the contract, have been defined in this ToR and its appendices. This ToR describes the subject of the contract in a complete and exhaustive manner. The principles and quality standards for the provision of waste collection and management services are contained in the Act of 14 December 2012 on waste (Journal of Laws of 2016, item 1987, as amended) and in the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners.
