The Federal Network Agency (contracting authority) is to be provided with expert support in determining the general sectoral productivity factor for gas and electricity supply networks in the fourth regulatory period. Within the framework of the expert opinion to be commissioned, in particular against the background of the case law of the Higher Regional Court of Düsseldorf and the Federal Court of Justice, the previous discussion of the developments of the productivity as well as the cost prices of the gas and electricity supply networks compared to the overall economy should therefore be reviewed to determine whether the methods used so far continue to ensure an appropriate determination of the general sectoral productivity factor for the fourth regulatory period or whether other approaches are now tangibly superior. In the context of this debate, therefore, the state of the art with regard to the methods to be applied is to be reviewed in particular. The task is to be documented for the administrative process.
