Description

The subject of the contract is the expansion of the Ordering Party's server infrastructure (hereinafter referred to as the "assortment"). The Contractor shall deliver and install the assortment in the indicated racks in the Ordering Party's server room located in building B, at 12 Niepodległości Avenue in Poznań.
(1) The subject of the order is the expansion of the Ordering Party's server infrastructure (hereinafter referred to as the "assortment"). The Contractor shall deliver and install the assortment in the indicated rack cabinets in the Ordering Party's server room located in building B, at 12 Niepodległości Avenue in Poznań.2. The scope of the subject matter of the contract also includes:- provision of warranty and performance by the Contractor of the benefits arising therefrom. Detailed requirements for the warranty are set out in the draft agreement attached as Annex No. 9 to the SWZ.The warranty for the Purchaser is the Contractor, but this does not relieve the Contractor from the obligation to provide warranty documents, licenses, technical support, etc. of the manufacturer of the offered assortment, if such are provided by him with the equipment.3. The supplied equipment must meet the conditions of CE marking and be marked with this mark.4.The assortment constituting the subject matter of the order must come from official distribution channels covering also the European Union market, ensuring in particular the realization of warranty rights.5. The Contractor guarantees that the assortment constituting the subject matter of the order offered by him is legally marketed and used in the European Union.6.The assortment must be brand new, i.e. not used before the date of delivery - excluding the use necessary to test its correct operation.7. The assortment must be supplied with accessories, manuals and other items necessary for its launch in a configuration consistent with the requirements and minimum parameters specified in the technical and price specification constituting Appendix No. 2 to the SWZ, and if applicable to the assortment - a complete list of consumables with marked warranty periods and prices.8.The assortment to be powered from the mains must be equipped with an adequate number of power cables allowing it to be plugged into standard power outlets, unless otherwise noted in the technical and price specification.9. The Contractor guarantees that the offered assortment will have the service of the manufacturer of such equipment, with service carried out in Polish. 10.The Contractor's price offer must include all costs associated with the implementation of the subject matter of the order in accordance with the requirements of the SWZ, including, among others, the cost of delivery of the subject matter of the order to the registered office of the Purchaser, insurance for the duration of delivery , service reviews and technical support in accordance with the Contractor's offer. Accordingly, the Contractor shall not be entitled to demand from the Ordering Party to cover any additional costs related to the execution of the subject matter of the order.11.The Ordering Party reserves the right to verify the supplied assortment in the execution of this order, in terms of legality of origin and other statements of the Contractor.
