Description
The subject of the contract is the physical protection of persons and property by specialised armed robbery formations (SUFOs), on the premises of military units.2The subject matter of the contract was divided into 3 parts: Part I - protection of the military complex no. 3961 in the Łask area at 1 Lotników Łaskich Square and protection of the military complex no. 6030 in the Gucin 58A, consisting of:2.1. 24-hour shift protection of persons and property located within the protected areas and facilities;2.2. organization of the security service on the basis of a system of posts and pedestrian patrols, car patrol, intervention patrol and porters;2.3. guarding the property, devices supporting the protection, protecting it against theft, destruction or damage within the military complex;2.4. controlling documents entitling to enter (enter) the military complex or its part, carry out/carry (remove/import) the property and preventing illegal entry of bystanders to the protected areas;2.5. direct protection of the objects through patrolling, observation and launching an intervention patrol for immediate reaction, which shall arrive and take active action immediately after receiving a signal of threat to the object, but not later than within 5 minutes from the moment of calling to each object on the premises of the military complex No 6030;2.6. 2.6. to protect the objects directly by patrolling, observing and launching an intervention group for immediate reaction, which will arrive and will take active action immediately after receiving a signal of threat to the object, but no later than 10 minutes from the call to the object on the premises of the military complex No 3961;2.7. to develop and agree with the Contracting Authority "Instruction for the protection of military complexes No 3961 and 6030". (which will constitute an annex to the agreement) by 28.12.2020;2.8. handing over the Military Police, the Police or military law enforcement bodies of persons captured during the performance of protective tasks;2.9. maintaining cooperation in the field of protection of persons and property with the officer on duty of JW 1158, the Military Police, the Police and fire protection units;2.10. maintaining cooperation with other internal services located in the protected area;2.Part II - protection of the military complex (No. 4585) in Wronowice, consisting of:2.12. protection of people and property carried out in a 24-hour shift system, consisting of direct physical protection, constant supervision of signals transmitted, collected and processed in electronic alarm systems and devices;2.13. 2.13. guarding the property, devices supporting the protection, protecting it against theft, destruction or damage on the area of the military complex;2.14. controlling documents entitling to enter (enter) the area of the military complex, carry out/carry (remove/import) the property and preventing illegal entry of bystanders into the protected areas;2.15. 2.15. guaranteeing free of charge operation of a minimum 2-person intervention group in the event of an immediate threat to the facility or its occupants - the time of the intervention group's arrival up to 10 minutes after receiving a signal about the threat to the facility;2.16. developing and agreeing with JW 2748 a security instruction (which will constitute an annex to the agreement) by 28.12.2020;2.17. handing over the Military Police, the Police or the military order organs of persons captured during the performance of security tasks;2.18. maintaining cooperation with Commander 170. 2.18. maintaining cooperation with the Commander of the 170th Primary and Non-Permanent Commander of security and other internal services located within the protected area;2.19. close cooperation with the Military Police and the Police and fire protection services to ensure the safety and security of the facility;2.20. ensuring 24-hour staffing of internal posts in the protected complex for the duration of the contract;2.21. 2.21. Providing a designated person from JW 2748 with a list of security personnel assigned to the execution of the agreement, its updating in case of changes (the list is to contain personal data of all employees assigned to the security, however, it should not contain more than 25 persons, with the Contractor's obligation to provide the list at least three days before the introduction of a new employee, and moreover, during the term of the agreement it is allowed to correct the list, however, not more than 25% in relation to the first list provided);2.22. 2.22. ensuring proper social conditions for rest for security personnel staying in the contractor's designated premises, including equipment for meal preparation and storage; 2.23. organising a robbery system for security personnel performing tasks at the stations, the security commander and the commander of the 170th Combat Shift on Duty (robbery pilots and devices for receiving robbery signals); 2.24. performing other tasks resulting from the security plan, security instructions and emergency situations.Part III - protection of the military complex (No. 2617) in the city of Sieradz at 78 Wojska Polskiego Street, (No. 2618) in the city of Sieradz at 6 Sienkiewicza Street and (No. 8675) in the city of Sieradz at 19 Kościuszki Street, consisting of:2.25. 2.25.1. ensuring 24-hour physical protection of persons, areas, facilities, equipment and property located within the protected areas, in terms of preventing, inter alia:2.25.1. crimes against the Republic of Poland (Chapter XVII of the Act of 6 June 1997 - the Penal Code (i.e. Journal of Laws 2019, Dz. 2.25.2. offences against defence (Chapter XVIII Article 140 and Article 142 of the Penal Code);2.25.3. offences against life and health (Chapter XIX of the Penal Code);2.25.4. offences against universal security (Chapter XX of the Penal Code);2.25.5. 2.25.5. offences against the environment (Chapter XXII CC);2.25.6. offences against the activities of state institutions and local government (Chapter XXIX CC);2.25.7. offences against public order (Chapter XXXII CC);2.2.25.8. crimes against the protection of information (chapter XXXIII CC);2.25.9. crimes against property (chapter XXXV CC);2.26. organization of the security service on the basis of a system of checkpoints, patrols and intervention patrols;2.27. responding to any signal of a breach of the system of protection of protected facilities and strict performance of the tasks specified in the security instructions regardless of time of day and weather conditions;2.28. 2.28. conducting continuous observation of the situation in the protected military complex no. 2617 and the adjacent area, monitoring and intervention in military complexes no. 2618 and 8675;2.29. controlling and enforcing the observance of established norms of behaviour and public order by persons staying in the protected area;2.30. capturing perpetrators of crimes committed within the protected area in order to immediately hand them over to the Police or the Military Police Force;2.31. 2.31. not allowing to steal, destroy or damage the military property entrusted for protection, located on the protected areas;2.32. protecting the objects directly by patrolling, observing and launching intervention patrols for immediate reaction, which will arrive and take active action immediately after receiving a signal of threat to the object(s), but no later than 10 minutes from the moment of receiving such a signal to any place on the territory of military complex no 2617 and military complexes no 2618 and 8675;2.33. directing or bringing the interested parties to the authorized functionaries of military complex No. 2617 in accordance with the rules set forth in the security instruction;2.34. keeping the security service records specified in the security instruction;2.35. drawing up written reports on the course of service in the appropriate documentation and making ad hoc reports, if necessary;2.36. drawing up monthly notes on the course of service by security commanders;2.40. maintaining close cooperation in the field of the protection of military complexes with the officer on duty of JW 1551;2.41. cooperating with the internal police forces, internal services and the State Fire Service, Military Police, Municipal Police, within the protected military facilities in the implementation of protection projects, counteracting threats and providing mutual assistance;2.2.42. using the keys for current use deposited in the key depositories in accordance with the rules set forth in the security instruction;2.43. informing the officer on duty JW 1551 about failures in the technical protection of the protected property (this applies in particular to devices supporting protection, locks, locks, fences, lighting, fire protection, 2.44. analysing the current internal and external threats and proposing changes in the security system;2.45. conducting current training of security personnel and shooting by all security personnel with the weapon that is in their equipment at least once every three months (including the above mentioned above) 2.46. developing and agreeing with JW 1551 a "Security Instruction" for the military complex within 14 days of signing the agreement with the Contracting Authority, which will constitute an annex to the agreement; 2.47. performing other tasks related to the protection of objects and property resulting from the extract from the "Complex Security Plan", the "Security Instruction", and emergency situations.3 2.45. conducting ongoing training for security personnel and shooting by all security personnel from the weapons they are equipped with, at least once every three months (the above mentioned projects should be documented and submitted to the commanding officer of JW 1551 not later than 14 days after the shooting)All equipment and vehicles must be operational (free from defects) in order to properly secure the security system.4.The Ordering Party reserves the right to require the Contractor to issue an additional post(s) (patrols) in any indicated place within the protected area, e.g.: a) in the case of a need, b) in the case of an emergency. 240 hours in each year (or more hours indicated by the Contractor, however, not more than during the year for Part I - 500 hours and for Parts II and III - 300 hours), without additional costs under the contract.7 All security personnel at the work place must be equipped by the Contractor with their own means of radio-telephone communication in order to ensure communication between them within the given military complex (from any place within the protected area).8 All security personnel appointed to perform the contract must be employed in compliance with the requirements of Section 6 of the Act of 26 June 1974. - All security personnel designated to carry out the contract must be employees employed on the basis of a contract of employment at least full-time in accordance with art. 22 of the Code of Labour and constitute a permanent branch separated for the protection of facilities indicated in the ToR, in accordance with the list of persons who will perform the contract.10Prior to commencing the performance of the contract, the Economic Operator undertakes to provide JW 1158 (for Part I), 170th Precinct (for Part II) and 1551 (for Part III) with a list of persons delegated by the Economic Operator to perform the contract and copies of the documents of security personnel (contracts of employment of security personnel - employees designated for the performance of the contract), confirmed for compliance, and upon hiring any new security personnel (prior to entering the facility), the Economic Operator undertakes to provide a certified copy of the employment contract of this employee.11All security personnel appointed to perform the contract must be fluent in Polish and have Polish citizenship.12 Due to the specific nature of the protected facilities, the Contracting Authority does not provide for the possibility of employing disabled persons with a recognised degree of disability within the meaning of the regulations on professional and social rehabilitation and employment of disabled persons.13All security personnel performing security tasks under Part II are obliged to undergo training conducted by the representatives of JW 2748 in the field of health and safety and fire protection before starting to carry out the tasks.14 The Contracting Authority informs that the premises for the security personnel will be separated free of charge for SUFO employees and possibly other premises and utilities will be provided free of charge (water, CO, electricity, waste collection). Adjustment of rooms to SUFO requirements, cleaning agents, current sanitary and hygienic service, cleaning of transferred rooms and removal of damage caused by intentional or unintentional guards shall be secured by the Contractor.15 Moreover, in order to implement Parts I, II, III, the Contractor shall ensure appropriate social conditions for rest for security personnel in separate rooms, including the obligation to organize and equip places for preparing and storing meals.16. For Part I - The Contractor agrees to provide protection services after the imposition of martial law, martial law, after the announcement of mobilization or when JW 1158 is ready to take action by providing protection services under this specification and to strengthen protection by organizing, within 12 hours from the time of receiving such information, additional five cbk or PM and direct coercive measures and three pedestrian patrols with cbk or PM and direct coercive measures (total: at least 17 security personnel per shift in the 24-hour system at the place indicated by the Purchaser), under the concluded agreement. This reinforcement of security shall be carried out for a period agreed with the Contracting Authority but not exceeding 21 days.17For Part II - the Contractor agrees to provide protection services after the introduction of martial law, martial law, after the announcement of mobilization or during the time of reaching readiness to take action by 170 prdz by providing protection services resulting from this specification and to strengthen the protection by organizing within 12 hours from receiving such information from JW 2748, an additional 2-person patrol with cubes together with ammunition and direct coercion (together: at least 3 security personnel per each shift in the 24-hour system at the place indicated by the 170 prdz Commander), under the concluded agreement. The scope of additional protection required during the introduction of readiness to take action will be specified in JW 2748 in agreement with JW 1158.18. For Part III - the Contractor agrees to provide protection services after the introduction of martial law, martial law, after the announcement of mobilization or during reaching readiness to take action by JW 1551 by providing protection services resulting from this specification and strengthening protection by organizing within 12 hours from receiving such information, two additional protection posts with cbks together with ammunition and direct coercive measures and a pedestrian patrol with cbks together with ammunition and direct coercive measures (together: at least 6 security personnel per shift in the 24-hour system at the place indicated by Commander in Chief JW 1551), under contract.19Additional requirements related to the performance of the subject matter of the contract:19.1. The contract may be tendered for by Economic Operators who act in accordance with the provisions of the Act on the protection of persons and property (i.e. Journal of Laws 2020, item 838) of the Act on the protection of classified information (i.e. Journal of Laws 2019, item 838). item 742), the Act on Arms and Ammunition (i.e. Journal of Laws 2020 item 955) and the Act on Direct Coercion and Firearms (i.e. Journal of Laws 2019 The Contractor is obliged to actively engage protective forces (security staff, patrols and intervention groups) in quarterly trainings and annual training with a fake breach of facility protection with the participation of the Military Police and the Military Police (five times a year on the date indicated by the commander of a given military unit).19.3. The contractor shall provide all security personnel performing security tasks, according to the time of the year, with uniform official uniform with a headgear with signs of belonging to the employing entity, while the clothing of security personnel will be visibly different from the uniform in force in the Ministry of National Defence and public service employees.19.4 A new security staff member shall be hired to perform security tasks only after prior consent has been obtained from the Contracting Authority or from the person indicated in the contract as the person responsible on the part of the Contracting Authority for receiving the subject of the contract. 19.5 A contractor shall protect the weapons of its employees on its own, however, the Contracting Authority shall inform that it shall make one room available for Parts I and III of the order in order to adjust it to the requirements of the weapons warehouse for the needs of SUFO performing protection tasks exclusively for the needs of a given part of the order. For Part II, the Contractor shall place its own safe for storing weapons in a room dedicated to SUFO.19.6 The security personnel who have weapons at their disposal, indicated for the execution of the order, shall have appropriate authorisations (permits, IDs) to use the firearms required during the execution of the order.19Arrangements and decisions concerning details of contract execution shall be made by authorised representatives of the Contracting Authority and the Contractor, however, it is required that the Contractor specifies contact telephone numbers, fax numbers and other arrangements necessary for the proper execution of the contract.19.8 The Contracting Authority is obliged to ensure fire and technical protection of the protected facilities and necessary lighting of the protected facility.1919.9 The Contracting Authority reserves the right to inspect the security service in the protected area.19.10. The Commander in Chief of JW 1158 is also authorized to inspect the performance of security tasks for each part of the contract, as well as persons indicated by the Commander in Chief of JW 1158, within the scope of the Contractor's compliance with the provisions of the contract, and other persons specified in separate regulations who are authorized to inspect the security of organizational units and units, military facilities and equipment.19.11 The scope of control activities shall include checking the condition and quantity of equipment, preparation to perform security service, external appearance of security staff and their soberness.19.12 During the execution of the agreement, the Economic Operator is obliged to have a valid license of the Ministry of Interior/MSA to conduct business activity within the scope of protection of persons and property, carried out in the form of direct physical protection - permanent and temporary, as well as technical protection (applies to Parts I, II and III).19.13. During the execution of the agreement, the Economic Operator is obliged to have a valid industrial security certificate of at least the third degree confirming the ability to protect classified information with the Confidential Classification (applies to Parts I and III).19.14. Persons performing the control, in particular, have the right to:19.14.1.carry out current control of the execution of protective tasks by security staff at any time of day and night;19.14.2.control the required documents of security staff (a document authorizing access to classified information, a card of a qualified physical security staff member, a card of a person authorized to possess weapons, employment contract, etc.);19.14.3.ad hoc supervision over the required shootings performed by the Contractor's security staff for the needs of the contract execution;19.14.4. 19.14.4. requesting the Contractor to change the security staff, if there is a suspicion of not keeping secret the information that he became acquainted with while performing the security tasks or if there are objections to the manner in which he performs the security tasks;19.14.5. giving instructions to the security staff related to proceedings against outsiders detained in the protected area;19.14.6. controlling the state of security of the protected facilities together with the adjacent area;19.14.7. agreeing with the Contractor's representative on the manner and variants used in performing the security service;19.14.14.8. request that the Contractor's security personnel report the situation in the protected facilities on an ad hoc basis;19.14.9. provide comments to the inspected security personnel on identified deficiencies while on duty;19.14.10. request that inspected security personnel rectify identified deficiencies and irregularities;19.14.11. inspect the technical records of security equipment in the protected area;19.14.12. control the state of sobriety and the content of narcotic drugs in the body of security personnel;19.15 An entry shall be made in the "Logbook" kept by the security commander, signed by the person conducting control, or another relevant document (record, note) confirming the inspection (supervision) shall be made, describing the comments and observations of the inspection (supervision).19.16 19.19.16. In the case of documented gross breach of duties by a security guard, at the request of the Ordering Party the Contractor shall be obliged to remove him from service and not allow him to perform his duties - at the same time the Contractor shall issue another security guard having at least the same qualifications (authorizations).19.17. Before commencing the execution of the contract no later than 18.12.2020. The Economic Operator shall submit to the Commander of JW 1158 (for Part I), the Commander of 170th Precinct (for Part II) and the Commander of JW 1551 (for Part III) a list of personnel who will perform the contract or participate in the performance of the contract and before a new employee commences performing the tasks for approval. The list must be accompanied by photocopies of documents confirming the possession of qualifications necessary to perform the contract (a qualified physical security officer's ID card, a person authorized to possess weapons, a document authorizing access to classified information, a certificate confirming training in the protection of classified information and a current medical certificate of no contraindications to work and an employment contract), as well as a certificate of enrollment on the list of qualified physical security officers as far as the above mentioned personnel are concerned, issued by authorized police authorities.19.18 Prior to commencing the performance of security tasks, all security personnel must undergo training on the specificity of performing security service in the protected areas covered by the order, which will be conducted by the commanding officer of security for a given part of the proceedings.19.19 All security personnel (applicable to Part III) shall have a security clearance authorising access to information classified at least as "DISCLAIMED" or authorisation to access information classified as "DISCLAIMED" and the commander of security shall have a security clearance authorising access to information classified at least as "CONFIDENTIAL".19.20 The Contractor undertakes to provide the authorized representative of the Ordering Party (specified in the contract) by the 25th of each month with a list (plan, schedule) of security personnel on duty in the following month under the contract signed.19.21 The detailed tasks and method of operation of SUFO shall be specified in the security instruction, which shall be prepared and signed by the Contractor and the Ordering Party and signed (accepted) by the commander of the organizational unit on the territory of which the order shall be executed (after signing it shall constitute an annex to the contract).
