The subject matter of this order is: The scope of the Order includes 1 part.3. Quantities, characteristics and technical and user parameters of the subject matter of the Order are specified in Attachment No. 9 Assortment and price forms, Attachment No. 2 Description of the subject matter of the Order and Attachments No. 1, 5, 5, 5d to the Specification of Essential Terms of Order (ToR).4. The Contractor will not demand the full quantity of the subject of the order described in Appendix 9, and will not demand compensation from the Ordering Party for this, provided that the Ordering Party uses not less than 60% of the assortment.6 The offered subject of the order should meet the requirements specified by the Ordering Party in: a) Act of 20.5.2010 on Medical Devices (Journal of Laws of 2017, item 211, as amended) - if applicable, b) Regulation of the Minister of Health of 17 February 2016 on essential requirements and conformity assessment procedures for medical devices (Journal of Laws of 2016, item 211) - if applicable, c) it should meet the technical requirements contained in the ToR and annexes to the ToR7. The term "equivalent offer" means the subject matter of the contract that is at least equal in terms of the described norms, standards, parameters, technical and quality features. The described parameters of the subject of the contract constitute the minimum quality required by the Ordering Party. A Economic Operator who submits an equivalent offer is obliged to inform the Contracting Authority about this fact and demonstrate that the subject of the contract offered by him meets the requirements specified by the Contracting Authority, by providing information about the fulfilment of features indicated by the Contracting Authority as equivalent. Proof of equivalence shall be at the discretion of the Contractor.
