Description

The subject matter of the contract is to provide services of the Patient Information Telephone Helpline for the National Healthcare Fund.2 A detailed description of the subject matter of the contract is included in Appendix 1 to the Specification.3 The detailed scope of rights and obligations related to the performance of the contract is specified in the model contract attached as Appendix 2 to the Specification.4 Requirements of the Contracting Authority concerning the form of employment of the Contractor's employees - Article 29 paragraph 3 a of the Act: a) The Contractor is obliged to employ, on the basis of an employment contract, at least 10 consultants assigned to the performance of the contract and performing the duties indicated and described by the Contracting Authority in the Description of the subject matter of the contract in point A) of the Act: a) The Contractor is obliged to employ, on the basis of an employment contract, at least 10 consultants assigned to the performance of the contract and performing the duties indicated and described by the Contracting Authority in the Description of the subject matter of the contract in point Błąd! 1.2 The substantive scope (Annex No. 1 to the specification) as consisting in performing work in the manner specified in Article 22 § 1 of the Act of 26.6.1974. - Labour Code.b) The Economic Operator is obliged to maintain for the entire duration of the contract the same number of full-time employees as indicated in point a) c) The employment referred to in point a) will last for the entire period of performance of the contract.d) The Economic Operator is obliged to document the employment of the persons referred to in point a) within 14 days from the date of signing the contract by providing the Contracting Authority with evidence of employment in the form of a statement of employment of a person, copies of employment contracts certified to be true to the original by the Economic Operator. A copy of the agreements should be anonymised in a manner ensuring the protection of employees' personal data in accordance with the provisions of the Regulation of the European Parliament and of the Council (EU 2016/679 of 27.4.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (general regulation on data protection, OJ L 119 of 4.5.2016).e) In case of expiration or termination of the employment contract with the persons referred to in point a), the Contractor shall be obliged to employ further persons within 14 calendar days from the termination of the employment relationship. Each time the contract of employment expires or is terminated with persons referred to in point a), the contractor is obliged to immediately notify the contracting authority. f) The contracting authority will be entitled to inspect the contractor's compliance with the obligation to employ persons referred to in point a). At the request of the ordering party, the contractor shall be obliged to submit, within 5 calendar days, the documents referred to in point (d). Control activities may also be carried out by an employee designated by the contracting authority at the place of performance of the service.
