The purpose of the service concession is to enable the provision and operation of a public communications network and the provision of public communications networks in the expansion area. In this context, reference is made to the exception in Section 149 No. 8 GWB and, as the present portal does not provide for a corresponding concession notice, recourse was alternatively made to the "Other" regulation and the "competitive tendering" type of award. However, this does not change the actual classification of the subject matter of the procurement and its implementation as a negotiated procedure.==================================================================================================================================================== The municipality of Gmund am Tegernsee (hereinafter: "grantor") aims to establish high-performance access to gigabit networks throughout the area. In addition, the franchisor is pursuing the goal of strengthening its local areas as a business location and ensuring the competitiveness of its local companies. For this reason, concession agreements are to be concluded with telecommunications companies for the construction and operation of gigabit networks and the provision of end-customer services in the areas specified below. The franchisor has submitted an application for funding under the federal government's funding program "Promotion of the Gigabit Expansion of Telecommunications Networks in the Federal Republic of Germany - Gigabit Guideline 2.0" and has been granted a provisional amount of funding. In addition, the franchisor intends to apply for co-financing in accordance with the "Directive on the co-financing of gigabit expansion by the federal government in the Free State of Bavaria 2.0" (Bavarian Co-Financing Gigabit Directive 2.0 - KofGibitR 2.0).
