Description

The city of Lörrach with about 49 000 inhabitants is located in Baden-Württemberg. ED Netze GmbH is the owner of the electricity supply network for the general supply and the current holder of the rights of way in accordance with § 46 Para. 2 of the Energy Industry Act (EnWG) in the Lörrach municipal area without the district of Hauingen. The road usage contract between the town of Lörrach and ED Netze GmbH (as legal successor of Kraftübertragungswerke Rheinfelde AG) according to § 46 Para. 2 EnWG ended on 31.12.2018. Now, the town of Lörrach awards a new road usage contract according to § 46 Para. 2 EnWG for the electricity supply network of the general supply in the town area of Lörrach without the district of Hauingen. This is associated with the task of operating a corresponding supply network. The road usage contract to be concluded provides for a maximum term of 20 years.
The concessionaire is obliged by the conclusion of the electricity concession contract with the City of Lörrach to operate the electricity supply network for the general supply in the Lörrach municipal area, without the Hauingen district, during the term of the contract. In connection with the conclusion of the new electricity concession contract, the City of Lörrach will also examine whether an own involvement in the area of the electricity supply network is reasonable and possible. One possible option is to establish a cooperation company with a qualified interested party and award the electricity concession to the joint cooperation company.
