The subject of the order is the supply of 3 units of unmarked vehicles within three parts:Part 1 - 1 unit of C-segment vehicle,Part 2 - 1 unit of SUV No. 1,Part 3 - 1 unit of SUV No. 2.The subject of the order is described in detail in Appendix No. 1 (1.1, 1.2, 1.3) to the SWZ (OPZ).
Supply of 1 unit C-segment vehicle.The subject of the order is described in detail in Appendix No. 1 (1.1) to the SWZ (OPZ). c.d. z. pt. VI.4.3 c) Article 109.1.2.a of the Law,d) Article 109.1.2.b of the Law, concerning conviction for a misdemeanor punishable by arrest,e) Article 109.1.3 of the Law, concerning conviction for a felony or punishment for a misdemeanor punishable by arrest- prepared no earlier than 6 months prior to its submission;1.2.2 statement of the Contractor, within the scope of Article 108 paragraph 1 point 5 of the Act, on not belonging to the same capital group within the meaning of the Act of February 16, 2007. on competition and consumer protection (Journal of Laws of 2021, item 275), with another Economic Operator who submitted a separate bid, partial bid or request to participate, or a statement of affiliation to the same capital group, together with documents or information confirming the preparation of a bid, partial bid or request to participate independently of another Economic Operator belonging to the same capital group;1.2.3 certificate of the competent head of the tax office confirming that the Economic Operator is not in arrears with payment of taxes and fees, within the scope of art. 109 par. 1 item 1 of the Act, issued no earlier than 3 months before its submission, and in the case of arrears in payment of taxes or fees, together with the certificate, the Contracting Authority requires submission of documents confirming that, respectively, before the deadline for submission of requests to participate in the procedure or before the deadline for submission of tenders, the Economic Operator has paid the taxes or fees due, together with interest or fines, or has entered into a binding agreement on repayment of such receivables;1.2.4 certificate or other document of the competent field organizational unit of the Social Insurance Institution or the competent regional branch or the competent field office of the Agricultural Social Insurance Fund confirming that the Economic Operator is not in arrears with payment of social and health insurance premiums, within the scope of art. 109 section 1 item 1 of the Act, issued no earlier than 3 months before its submission, and in the case of arrears in payment of social or health insurance premiums, together with a certificate or other document, the Contracting Authority requires submission of documents confirming that, respectively, before the deadline for submission of requests to participate in the proceeding or before the deadline for submission of tenders, the Economic Operator has made payments of social or health insurance premiums due, together with interest or fines, or has entered into a binding agreement on repayment of such receivables;1.2.5 copy or information from the National Court Register or from the Central Register and Information on Business Activity, within the scope of art. 109 item 1 point 4 of the Act, made no earlier than 3 months before its submission, if separate regulations require entry in the register or registry;1.2.6 statement of the Economic Operator on the validity of the information contained in the statement referred to in Article 125, paragraph 1 of the Act, regarding the grounds for exclusion from the procedure indicated by the Contracting Authority, referred to in:a) Article 108, paragraph 1, point 3 of the Act,b) Article 108, paragraph 1, point 4 of the Act, regarding the ruling of a ban on applying for a public contract as a preventive measure,c) Article 108, paragraph 1, point 5 of the Act, regarding the conclusion of an agreement with other contractors aimed at distorting competition,d) Art. 108(1)(6) of the Act,e) Article 109(1)(1) of the Act, regarding violation of obligations regarding payment of taxes and local fees referred to in the Act of January 12, 1991 on local taxes and fees (Journal of Laws of 2019, item 1170),f) Article 109(1)(2)(b) of the Act, regarding punishment for an offense punishable by restriction of liberty or a fine,c.d. in pt. II.2.4 part 2 Supply of 1 SUV No. 1.The subject matter of the order is described in detail in Appendix No. 1 (1.2) to the SWZ (OPZ).c.d. from pt. II.2.4 part. Ig) Article 109.1.2.c of the Act,h) Article 109.1.3 of the Act, concerning punishment for an offense punishable by restriction of liberty or a fine,i) Article 109.1.5-10 of the Act.FOREIGN CONTRACTOR2. If the Economic Operator has its registered office or place of residence outside the borders of the Republic of Poland, instead of:a) information from the National Criminal Register referred to in item 1.2.1 of the SWZ - shall submit information from a relevant register, such as a court register, or, in the absence of such a register, another equivalent document issued by a competent judicial or administrative authority of the country in which the Economic Operator has its registered office or place of residence, to the extent referred to in item 1.2.1 of the SWZ;b) the certificate referred to in item 1.2.5 of the SWZ, certificate or other document confirming that the Economic Operator is not in arrears with payment of social or health insurance premiums referred to in item 1.2.5 SWZ, or a copy or information from the National Court Register or the Central Register and Information on Business Activity, referred to in point 1.2.6 of the SWZ - shall submit a document or documents issued in the country in which the Economic Operator has its registered office or place of residence, confirming, respectively, that:- he has not violated obligations relating to the payment of taxes, fees or contributions for social or health insurance,- he has not been liquidated, has not been declared bankrupt, his assets are not managed by a liquidator or a court, he has not made an arrangement with creditors, his business activity is not suspended or he is not in any other similar situation arising from a similar procedure provided for in the laws of the place where such procedure is initiated.3.The document referred to in paragraph 2(a) should be issued no earlier than 6 months prior to its submission. The documents referred to in paragraph 2(b) should be issued no earlier than 3 months prior to their submission.c.d. of item II.2.4 part 3 Delivery of 1 SUV No. 2.The subject matter of the contract is described in detail in Appendix 1 (1.3) to the SWZ (OPZ).c.d. of item. II.2.4 part 24.If in the country where the Contractor has its registered office or place of residence, the documents referred to in paragraph 2 are not issued, or if these documents do not refer to all cases referred to in Article 108 paragraph 1 points 1, 2 and 4, Article 109 paragraph 1 points 1, 2 lit. a and b and point 3 of the PPL Act, they shall be replaced in whole or in part, respectively, by a document containing a statement of the Economic Operator, indicating the person or persons authorized to represent him, or a statement of the person to whom the document relates, made under oath, or, if in the country where the Economic Operator has its registered seat or place of residence there are no provisions for a statement under oath, made before a judicial or administrative authority, a notary, a professional or economic self-government authority competent for the Economic Operator's seat or place of residence. Paragraph 3 shall apply.Grounds for exclusion from the procurement procedure.Pursuant to Art. 108 (1) of the PPL Act, the Contracting Authority shall exclude the Contractor:1) being a natural person who has been validly convicted of a crime: a) participation in an organized criminal group or association aimed at committing a crime or fiscal offence, referred to in Article 258 of the CC; b) human trafficking referred to in Article 189a of the CC; c) referred to in Articles 228-230a, 250a of the CC, in Articles 46-48 of the Sports Act of 25.06.2010 or in Article 54 (1-4) of the Act of 12.05.2011 on reimbursement of medicines, foodstuffs for special nutritional purposes and medical devices. special nutritional use and medical devices; d) financing of an offence of a terrorist nature, referred to in Article 165a of the CC, or an offence of preventing or hindering the establishment of the criminal origin of money or concealing its origin, referred to in Art. 299 of the Penal Code; e) of a terrorist nature, as referred to in Article 115 §20 of the CC, or with the aim of committing this offence; f) entrusting work to a minor foreigner, as referred to in Article 9(2) of the Law of 15.06.2012. on the consequences of entrusting work to foreigners residing in the territory of the Republic of Poland in violation of the law; g) against economic turnover referred to in Article 296-307 of the CC, offence of fraud referred to in Article 286 of the CC, offence against credibility of documents referred to in Article 270-277d of the CC, or treasury offence.h) referred to in Articles 9.1 and 9.3 or Article 10 of the Act of 15.06.2012 on the consequences of delegating work to foreigners unlawfully residing in the territory of the Republic of Poland - or for a corresponding prohibited act defined in the provisions of foreign law;2) if an incumbent member of its managing or supervisory body, partner of a sp. or supervisory body, a partner in a general partnership or professional partnership, or a general partner in a limited partnership or limited joint-stock partnership, or a proxy has been validly convicted of an offense referred to in item 1;3) against whom a final court decision or a final adm. on arrears in the payment of taxes, fees or contributions to social security or health care, unless the contractor, respectively, before the expiry of the deadline for submitting requests to participate in the proceedings or before the deadline for submitting tenders, has made payments of due taxes, fees or contributions to social security or health care, together with interest or fines, or has entered into a binding agreement on the repayment of these receivables;4) against whom a ban on applying for a public procurement has been validly decreed;c.d.w.p.
