Description

The subject of the contract is the delivery of pharmaceutical products divided into 33 packages.
The listed pharmaceutical products are described in detail in Appendix No. 7 to the ToR. The quantities indicated are annual average requirements over a 12-month period. The Ordering Party allows for the possibility of changing the quantity of ordered medicinal products and medical devices with the stipulation that the value of the signed contract cannot be increased. Actual demand shall result from the current needs of the Contracting Authority.
Pharmaceutical products which are the subject of the order should be understood as medicinal products within the meaning of the Pharmaceutical Law Act of 6 September 2001 (consolidated text: Journal of Laws 2017, item 2211, as amended). The offered medicinal products must be admitted to trading in accordance with the rules set out in Article 3 or 4, paragraphs 1 and 2 or 4a of the Pharmaceutical Law Act.
When offering a medicinal product, foodstuff for special nutritional use, medical device included in the list of reimbursed medicines, the Contractor must take into account the provisions of Article 9(2) of the Act of 12.5.2011 on reimbursement of medicines, foodstuffs for special nutritional use and medical devices (Journal of Laws No. 122, item 696), valid as of the date of submission of offers. In addition, the clarifications concerning Article 9(2) of the Communication of the Minister for Health of 26 March 2012 (letter MZ-PLR-460-12576-160/KB/12) should be taken into account.
