Description

1.The subject matter of the contract is the supply of electricity by the Contractor to the Ordering Party's power supply points indicated in Appendix 6 to the SWZ.2.The subject matter of the contract covers all power supply points and tariff groups listed in the List of power supply points constituting Appendix 6 to the SWZ.3.The Ordering Party's projected demand for electricity during the term of the contract is a total of 10,000 MWh.4: 10000 MWh.4.The Contracting Authority informs that in the subject proceeding conducted as an open tender, it provides for the possibility of applying the procedure referred to in Article 139(1) of the Public Procurement Law.The Contracting Authority, using the aforementioned procedure, will first examine and evaluate the tenders, and then perform the subject qualification of the Contractor whose tender was evaluated the highest in terms of lack of grounds for exclusion and fulfillment of the conditions for participation in the proceeding.
The subject matter of the contract is the supply of electricity by the Contractor to the Ordering Party's electricity consumption points indicated in Appendix 6 to the SWZ.2. The subject matter of the contract covers all electricity consumption points and tariff groups listed in the List of electricity consumption points constituting Appendix 6 to the SWZ.3. The Ordering Party's projected demand for electricity during the term of the contract is a total of: 10000 MWh.4. The determination of the volume of electricity in paragraph 3 does not constitute an obligation on the part of the Ordering Party to purchase electricity in the stated volume and does not give rise to a claim on the part of the Contractor to purchase energy in the stated volume, but only constitutes information for the Contractor on the Ordering Party's projected demand for electricity during the term of the contract. The stated volume of electricity specified in paragraph 3 is an estimated value based on the Ordering Party's consumption to date. Actual electricity consumption will depend on the actual needs of the Ordering Party. The Ordering Party reserves the right to reduce the total volume of electricity, relative to the amount specified in paragraph 3, subject to paragraph 5.Any change in the estimated consumption specified in paragraph 3 will not result in additional costs for the Ordering Party, in addition to settlement for the actual amount of electricity consumed.5. The amount of electricity purchased during the term of the agreement will not be less than 4,000 MWh.6. Electricity will be sold under the terms and conditions of the agreement and in accordance with:a) the provisions of the Act of 10 April 1997. - Energy Law (i.e., Journal of Laws of 2022, item 1385, as amended);b) the applicable regulations to the Energy Law;c) the provisions of the Act of April 23, 1964. - Civil Code (i.e., Journal of Laws of 2022, item 1360, as amended);d) the rules set forth in the license granted to the Contractor by the President of the Energy Regulatory Authority.The Contracting Authority has specified in Appendix No. 2 to the SWZ the quality requirements relating at least to the main elements comprising the subject matter of the contract.Additional information: The Contracting Authority does not provide for: payment of a deposit (art. 134 para. 2 item 4 of the Public Procurement Law);performance bond (art. 134(2)(5) of the p.z.p. Act);submission of variant bids, as referred to in Art. 92(1) of the p.z.p. Act (Art. 134(2)(6) of the p.z.p. Act);conclusion of a framework agreement (Art. 134(2)(7) of the p.z.p. Act);award of contracts referred to in Art. 214(1)(8) of the p.z.p. Act (art. 134(2)(8) of the p.z.p. Act);conducting a site inspection by the Contractor or verification by the Contractor of the documents necessary for the execution of the contract, as referred to in art. 131(2) of the P.Z.P. Act (Art. 134(2)(9) of the P.Z.P. Act);settlement in foreign currencies (Art. 134(2)(10) of the P.Z.P. Act);electronic auction (Art. 134(2)(12) of the P.Z.P. Act);reimbursement of costs of participation in the proceedings (Art. 134(2)(13) of the p.z.p. Act);requirements for employment on the basis of an employment relationship, in the circumstances referred to in Art. 95 of the p.z.p. Act (Art. 134(2)(14) of the p.z.p. Act);application of the requirements referred to in Art. 96(2)(2) of the P.Z.P. Act (art. 134(2)(15) of the P.Z.P. Act);reservation of the possibility of applying for the award of the contract only by the Economic Operators referred to in art. 94 of the P.Z.P. Act (art. 134(2)(16) of the P.Z.P. Act);submission of tenders in the form of electronic catalogs or attaching electronic catalogs to the tender, in the situation specified in art. 93 of the P.Z.P. Act (art. 134(2)(18) of the P.Z.P. Act);
