The subject of the invitation to tender is the supply of natural gas for various offtake points of the city of Pulheim in North Rhine-Westphalia. A total of approx. 59 offtake points with a reference consumption of approx. 16,222,462 kWh.Delivery period from 01.01.2024, 6.00 hrs to 01.01.2026, 6.00 hrs.
The subject of the invitation to tender is the supply of natural gas for various offtake points of the City of Pulheim in North Rhine-Westphalia. A total of approx. 59 offtake points with a reference consumption of approx. 16,222,462 kWh.Delivery period from 01.01.2024, 6.00 hrs to 01.01.2026, 6.00 hrs.- For all of the offtake points (SLP and RLM offtake points), only one common offtake / price group has been formed.- The bidder shall submit a working price for energy and service for all of the offtake point groups (SLP and RLM) separately for 2024 and 2025. This is evaluated.- A tolerance band (+/- 10 of the reference quantity) is agreed for all points of delivery (SLP, RLM). An excess/shortfall quantity settlement is made. The minimum purchase quantity per participant is 90 %, the maximum purchase quantity is 110 % of the agreed reference quantity (= contract quantity of all of the respective participant's offtake points registered for supply in the delivery period). - For the fixed-price variant, there is a maximum period of 4 hours between the offer and the preliminary notification. - The bidder must submit a self-declaration to secure supplies as part of the bidder declarationsIn order to protect the bidder as far as possible from price fluctuations in energy prices during the binding period of the bid, the tendering authority hereby gives a binding assurance that it will send the preliminary information pursuant to the ARC to the bidders by e-mail within 4 hours of the time of submission of the bid.There is thus a period of only 4 hours between the end of the bidding period and the preliminary information. Due to this very short period of time, the tendering body has deliberately refrained from including a price adjustment clause for the energy prices (indexation) between submission and preliminary information / award of contract.Due to the judgments of the ECJ (ECJ, judgment of 19.12.2018 - C-216/17 - "Antitrust and Coopservice") and ECJ, judgment of. 17.06.2021 - Case C-23/20) according to which a framework agreement shall lose its effect when the maximum limit is reached (cf. also OLG Koblenz, decision of 12.12.2022 - Verg 3/22) the following determination is made: The maximum quantity of the purchasable energy p.a. per lot is 200% of the quantity of energy specified as the reference quantity per lot (reference quantity) p.a. Note: This "maximum limit", which is included on account of the above-mentioned judgments and which is intended to lead to premature termination of the framework agreement if necessary if it is reached, applies irrespective of the so-called tolerance band of +/- 10% of the reference quantity if it is undercut / exceeded, a price adjustment may be made.For further details, reference is made to the specification of services together with the appendices.
