Natural gas for one offtake point of Wasserwelt Langenhagen, Eigenbetrieb der Stadt Langenhagen in Lower SaxonyTotal 1 offtake point with a reference consumption of 5,296,744 kWh/aDelivery period from 01.01.2024, 6.00 hrs to 01.01.2026, 6.00 hrs.
The bidder shall submit a service price for RLM separately for 2024 and 2025. This will be evaluated.The energy pricing RLM takes place according to spot market EEX Gas Price Reference EGIX (Germany) (THE Month) .No tolerance band is agreed for RLM.Due to the judgments of the ECJ (ECJ, Judgment of 19.12.2018 - C-216/17 - "Antitrust and Coopservice") and ECJ, Judgment of. 17.06.2021 - Rs. C-23/20) according to which a framework agreement shall lose its effect when the maximum limit is reached (cf. also OLG Koblenz, Beschl. v. 12.12.2022 - Verg 3/22) the following stipulation is made (which does not make sense in energy tenders, but is required by some TSPs):The maximum amount of purchasable energy p.a. per lot is 200% of the energy quantity specified as reference quantity per lot (reference quantity) p.a..The contract is awarded to the most economical bid that meets the conditions of the invitation to tender. The sole award criterion is the lowest price.The evaluation in the present procurement model is carried out according to the requirements of number 10 of the specifications.If no economic offer is received, the tender will be cancelled.
