4.1 The subject matter of the contract is the comprehensive supply of high-methane natural gas (group E), i.e. the supply of gas fuel together with distribution services to the gas consumption points (PPG) of the Ordering Party, divided into two parts of the contract:4.1.1. The 1st part of the contract concerns PPG settled according to mixed prices (tariff prices and competitive market), indicated in Appendix No. 1A to the SWZ, in the period from 01.01.2024 to 31.12.2024, with a fuel demand of 32,254,693 kWh - basic order,4.1.2. The second part of the order concerns PPG settled according to competitive market prices, indicated in Appendix No. 1B to the SWZ, in the period from 01.01.2024 to 31.12.2024, with a fuel demand of 1,883,408 kWh - basic order,
(1) The subject of the contract is the supply of gas fuel together with distribution services, settled according to mixed prices (tariff prices and competitive market), indicated in Appendix No. 1A to the SWZ, in the period from 01.01.2024 to 31.12.2024, o demand for fuel in the amount of 32,254,693 kWh - basic order,2. Gas fuel shall be delivered around the clock to the delivery and reception points, listed in Appendix No. 1A to the SWZ, which is a set of gas facilities for connecting the internal network owned by the Ordering Party with the gas network of the system operator.3. In the course of contract execution, the Ordering Party reserves the right to reduce or increase the quantity of gas fuel up to +/- 10% of the basic order. The increase in the quantity of gas fuel will be made on an option basis. The principles, scope and manner of exercise of the above by the Ordering Party are described in Appendix No. 2A to the SWZ - Draft contract provisions in par. 1 par. 3 and 4.4. In the event that the Ordering Party is/are an entity entitled to settle according to tariff prices approved by the President of the ERO within the meaning of the Act of January 26, 2022 on special solutions for the protection of gas fuel consumers in connection with the situation on the gas market, the GAS FUEL CONSUMER'S DECLARATION signed by the Ordering Party on the destination of gas fuel, according to the template attached to the Regulation of the Minister of Climate and Environment of January 28, 2022, has been attached to this proceeding. A given PPG may be partially or fully settled according to prices from the Sales Tariff approved by the President of the ERO - information is included in Appendix 1A to the SWZ - description of the subject of the contract. Settlement of the distribution service and purchase of gaseous fuel will take place in accordance with the rules set forth in the Energy Law of April 10, 1997, the Law of January 26, 2022 on special solutions for the protection of customers of gaseous fuels in connection with the situation on the gas market, the Law of December 15, 2022 on special protection of certain customers of gaseous fuels in 2023 in connection with the situation on the gas market, the distribution tariff and sales tariff approved by the President of the ERO. Statements of authorized entities are attached as Annexes 10A-10C to the SWZ. The gas fuel should be delivered 24 hours a day to the delivery and reception points, listed in Appendix No. 1B to the SWZ, which is a set of gas facilities for connecting the internal network owned by the Ordering Party with the gas network of the system operator.3. In the course of contract execution, the Ordering Party reserves the right to reduce or increase the quantity of gas fuel up to +/- 10% of the basic order. The increase in the quantity of gas fuel will be made on an option basis. The principles, scope and manner of exercise of the above by the Ordering Party are described in Appendix No. 2B to the SWZ - Draft contract provisions in par. 1 paragraphs 3 and 4.
