Description

The subject of the order is a comprehensive supply of gas fuel for the Regional Specialist Hospital in Grudziądz in the period 01.03.2020. - 31.12.2020 Natural gas should meet technical standards in accordance with the provisions of the Energy Law and its implementing regulations and Polish Standards.The estimated volume of gas supplied (+/-10 %) in the delivery period is 16 000 000 kWh.Additional information:1) The Awarding Entity does not accept partial bids.2) The Awarding Entity does not envisage:a) submitting variants (Art. 36 par. 2 item 4 of the Act);b) awarding contracts referred to in Art. 67 par. 1 item 4 of the Act on Public Procurement. 7 of the Act of Acts of Accession (Article 36(2)(3) of the CB); (c) the conclusion of a framework agreement (Article 36(2)(2) of the CB); (d) settlement in foreign currency (Article 36(2)(6) of the CB); (e) the electronic auction (Article 36(2)(6) of the CB); (f) the conclusion of a framework agreement (Article 36(2)(2) of the CB). 36(2)(7) of the Code of Criminal Procedure); f) reimbursement of costs of participation in the proceedings (Article 36(2)(8) of the Code of Criminal Procedure); g) application of the requirements referred to in Article 29(4) of the Code of Criminal Procedure.) The Contracting Authority does not reserve the obligation for the Contractor to perform key parts of the contract in person. The Contractor may entrust the performance of a part of the contract to a subcontractor - art. 36a.1 of the PPL Act. If the Contractor intends to entrust the performance of a part of the contract to a subcontractor, he should indicate the parts of the contract the performance of which he intends to entrust to subcontractors (art. 36b.1 of the PPL), the names of these subcontractors and whether the subcontractor is excluded under art. In the event that the Contractor fails to indicate the part of the contract the Contracting Authority shall entrust to subcontractors, the Contracting Authority shall deem that the entire contract will be performed by the Contractor on its own. Entrusting the performance of the part of the contract to subcontractors does not release the Contractor from the responsibility for proper performance of the contract. The Contracting Authority informs that there is an urgent need to award the contract consisting in securing gas supply to the Hospital. The Contracting Authority informs that the current contract is valid until 29.02.2020, and attempts to select the Contractor in two consecutive proceedings (open tender, free hand) have ended, due to the inability of the Contractors to meet the participation condition and the financial standing of the Hospital, with failure. It should be stressed that the supply of gas is necessary for the functioning of the Hospital, and the provision of this supply absolutely meets the conditions of higher necessity'. Therefore, it is justified to use the art. 43 section 2b item 2 of the Act on the Environmental Protection Law and to shorten the deadline for submitting offers.
