Description

The subject matter of the contract is the supply of E-type high-methane natural gas (GZ-50) at a pressure of not less than 1.6 kPa, with parameters compliant with the Energy Law, covering the sale and distribution of gas to the subordinate units of the Regional Police Headquarters in Łódź for a period of 24 months, to the point of consumption through an existing connection, entry point to the gas system - gas reduction station located on the land of the Ordering Party.2.The Contracting Authority provides for a reverse procedure, pursuant to Article 139 (1) of the PPL.3. In connection with the application of the procedure under Article 139 (1), the Contracting Authority does not require that the statement referred to in Article 125 (1) of the PPL be submitted with the bid. The Contracting Authority will require this statement only from the contractor whose bid is the highest evaluated.4. Pursuant to Article 257 para. 1of the Public Procurement Law, the Contracting Authority reserves the right to cancel the proceedings if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract are not awarded to him.
(1) The Ordering Party informs that as a Customer it is qualified to the seller's tariff group: for part 1 (KPP Wieluń) - G-22. The anticipated consumption of gas fuel for central heating and DHW purposes for the duration of the contract, as specified in the Price Form - Appendix No. 2 to the Terms of Reference, is 1,359,237.75 kWh and is an estimate (forecast), resulting from the actual gas consumption to date over a 12-month period from 01.07.2022 to 30.06.2023 (used for the purpose of bid comparison), which may change during the contract execution.3.. the Ordering Party reserves the right to reduce or increase the total amount of gas in relation to the amount specified in the Price Form - Appendix No. 2 to the SWZ. Any change in estimated consumption will not result in additional costs for the Ordering Party, in addition to settlement for the quantity of gas actually consumed.4 . the Contractor will supply natural gas during the term of the contract in quantities corresponding to the actual demand of the Ordering Party regardless of the estimated consumption forecast.5 .Any change in estimated consumption will not result in additional costs for the Ordering Party, in addition to settlement for the quantity of gas actually consumed.6. Settlements for the distribution of natural gas will take place on the basis of current indications of metering systems.7. The minimum estimated quantity of deliveries that the Ordering Party intends to make will not be less than 70% of the quantity specified in point. 2 of the Draft Provisions of the Contract - Appendix No. 8 to the SWZ, which shall not constitute a basis for claims on the part of the Contractor.8. The supply of natural gas shall take place on the basis of a contract containing the provisions of a sales contract and a contract for the provision of gas distribution services in accordance with applicable law, in particular on the terms and conditions specified by the Act of 10 April 1997. - Energy Law (i.e. Journal of Laws of 2022, item 1385, as amended) and the implementing regulations to the Act and the Act of February 16, 2007 on reserves of crude oil, petroleum products and natural gas and the rules of conduct in situations of threat to the state's fuel security and disturbances in the oil market (i.e. Journal of Laws of 2020, item 411).9 Charges for gas supply will be unchanged throughout the term of the contract, while distribution charges will be calculated in accordance with the applicable tariff of the distribution operator approved by the President of the Energy Regulatory Office.10. the Contractor shall be obliged to carry out the procedure for changing the seller before the date of commencement of deliveries to the Ordering Party's building, i.e. to submit on behalf of the Ordering Party to the Distribution System Operator (DSO) an application for notification of the change of seller, in accordance with the Distribution Grid Operation and Maintenance Manual (TNC) for the provision and use of natural gas distribution services. The applications should be submitted in time to allow an effective change before the date of commencement of deliveries to the Ordering Party's building. The Contractor shall bear all liability resulting from failure to comply with this obligation.11. The ownership of the gaseous fuel shall pass to the Ordering Party within the ownership limit of the OSD's gas network as specified in the terms and conditions of connection to the gas network.12. Under the concluded contract, gas quality standards shall be in force in accordance with Chapter 8 "Quality parameters of gaseous fuels, quality standards of customer service and the manner of settling complaints" of the Ordinance of the Minister of Economy of July 2, 2010 on detailed conditions for the operation of the gas system (i.e. Journal of Laws of 2018, item 1158). 1 The Ordering Party informs that as a Customer it is qualified to the tariff group of the seller: for part 2 (KP Głowno) - SG-12.
