1. ADVANCE CONTRACT AWARD NOTICE (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. DEFINITION OF THE REQUIREMENT
The Pelagic and Ecosystems Sciences Branch of the Department of Fisheries and Oceans (DFO) located at the Maurice-Lamontagne Institute in Mont-Joli, Québec, Canada has a requirement for a multisampling system suitable for the depth or distance stratified sampling of zooplankton on small vessels.
The only system identified as currently meeting DFO's operational requirements as detailed in this advance contract award notice is the "Multi Plankton Sampler MultiNet® type Mini" sampling system manufactured by Hydro-Bios, Germany, equipped with Conductivity/Temperature sensor Set (CT-Set) and Pitch and Roll Sensor, and for which Environmental Analytical Systems holds exclusive distribution rights in the Canadian market.
3. CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES (MINIMUM ESSENTIAL REQUIREMENTS)
Any interested supplier must demonstrate by way of a statement of capabilities that its product/equipment/system (as appropriate) meets the following requirements:
3.1 A minimum of five (5) nets that can successively sample five (5) distinct depths on horizontal, oblique and vertical tow.
3.2 Removable nets to repair or change meshes as needed.
3.3 High quality materials resistant to ocean conditions and high salinity (such as stainless steel and resistant mesh nets)
3.4 Maximum total weight of 125 kg.
3.5 Opening nets of 0.125 square meter.
3.6 An integrated pressure sensor capable of recording up to 3000 meters depth.
3.7 Two automatic angle-compensated electronic flowmeters to measure both the amount of water passing through the nets and outside the opening to determine clogging effects.
3.8 Collection of data of net status, conductivity, depth, water flows (internal to net and external to frame), and tilt/roll data transmission from instrument to surface in real time or recorded internally.
3.9 Can be both 1- standalone (deployment of preprogrammed nets and recording of data in internal memory during the operation) in case a connector cable is not available on board the vessel or 2- surface controlled deployments of nets and real time bi-directional data transfer over conducting cable.
3.10 Having a control unit provided.
3.11 Be equipped with internal batteries for independent operation of the ship's power supply.
4. APPLICABILITY OF THE TRADE AGREEMENTS TO THE PROCUREMENT
This procurement is subject to the following trade agreements:
- Canadian Free Trade Agreement (CFTA); and
- North American Free Trade Agreement (NAFTA);
5. JUSTIFICATION FOR THE PRE-IDENTIFIED SUPPLIER
The Multi Plankton Sampler MultiNet® type Mini" sampling system manufactured by Hydro-Bios, Germany, is the only known product to be able to meet the minimum essential requirements described in this ACAN.
Company "Environmental Analytical Systems" is the only authorised distributor of Hydro-Bios products in Canada. Thus, according to the purchasing policies of Government Contracts, the Department of Fisheries and Oceans proposes to award the contract to " Environmental Analytical Systems", that is, to our knowledge, the only company who is able to fulfill the requirement and that the product meets all of the evaluation criteria.
6. GOVERNMENT CONTRACTS REGULATIONS EXCEPTION
The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d): Only one person or firm is capable of performing the work.
7. EXCLUSIONS AND/OR LIMITED TENDERING REASONS
The following exclusion(s) and/or limited tendering reasons are invoked under the section of the trade agreement(s) specified:
7.1 Canadian Free Trade Agreement (CFTA)
Chapter Five - Government Procurement
Article 513: Limited Tendering
1. Subject to paragraphs 2 and 3, and provided that it does not use this provision for the purpose of avoiding competition among suppliers or in a manner that discriminates against suppliers of any other Party or protects its own suppliers, a procuring entity may use limited tendering in the following circumstances:
b. if the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons:
iii. due to an absence of competition for technical reasons.
7.2 North American Free Trade Agreement (NAFTA)
Part Four: Government Procurement - Chapter Ten Article 1016:
Limited Tendering Procedures: 2. An entity may use limited tendering procedures in the following circumstances and subject to the following conditions:
b. where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.
8. PROPOSED DELIVERY DATE
All the deliverables must be received within a period of ninety (90) calendar days after the contract is awarded.
9. COST ESTIMATE OF THE PROPOSED CONTRACT
The estimated value of the contract is less than 80,000$, taxes not included.

Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
12. CLOSING DATE FOR A SUBMISSION OF A STATEMENT OF CAPABILITIES
The closing date and time for acceptation statements of capabilities is on December 3, 2019 at 2:00 p.m. eastern standard time (EST).

An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
