Description

The subject matter of the contract is sale and delivery of medicinal products, dressing materials and medical devices within 33 groups.
Group 1 - Mineral compounds Contract modifications allowed by the Ordering Party - concern all groups within the scope of conducted proceedings.1) in case of occurrence of circumstances indicated in the Public Procurement Law, particularly in art. 455 of the PPL Act, according to the rules defined in this law.2) in the scope of replacement of products/goods being the subject of delivery with substitute products/goods, maintaining the parameters and scope of application at least equivalent to products/goods being the subject of this agreement and the price not higher than specified in this agreement in case of temporary or permanent unavailability of products/goods specified in the agreement, including termination of production or withdrawal from the market of the product being the subject of the order; this circumstance must be demonstrated by the Contractor.3) in the scope of replacement of products/devices being the subject of delivery with substitute products/devices maintaining the parameters and scope of application at least equivalent to the products/devices being the subject of this agreement and the price not higher than specified in this agreement in case of introduction of a new product/device being the equivalent of the product/device being the subject of the agreement,4) in the scope of prolongation of the agreement duration in case the subject of the agreement is not fully executed within the period specified in the agreement; the total duration of the agreement, the duration of which has been prolonged, cannot be longer than 48 months.5) the possibility to reduce unit prices in the event of circumstances affecting the reduction of the price of the product / product being the subject of delivery. 6) in case of appearance of an equivalent in the Contractor's commercial offer of any, several or all products/goods being the subject of delivery, with parameters not worse than defined in the subject of the contract, with price lower than the price of products/goods being the subject of delivery, the Parties allow for replacement of the product/good being the subject of delivery with a product/good with a lower price.7) it is possible to change the amount of remuneration due to the Contractor in case of changes in: a. goods and services tax rate and excise tax rate, b. minimum remuneration for work or amount of the minimum hourly rate established on the basis of provisions of the act of 10 October 2002 on the minimum remuneration for work,c. the rules of being subject to social insurance or health insurance or the amount of the social insurance premium rate,c. the rules of collecting and the amount of payments to employee capital plans referred to in the Act of October 4, 2018 on employee capital plans if these changes will affect the costs of the Contractor's performance of the contract.
