Description

The delivered foodstuffs should meet the requirements and marking standards specified in the following provisions:1) Act of 12 December 2003 on General Product Safety (Journal of Laws of 2016, item 2047, as amended)2) Act of 25 August 2006, on food and nutrition safety (Journal of Laws of 2019, item 1252, as amended) with implementing provisions3) Regulation of the European Parliament and of the Council of the EU No 1169/2011 of 25 October 2011 on the provision of food information to consumers4) Regulation of the Minister of Agriculture and Rural Development of 23 December 2014 on the labelling of particular types of foodstuffs (Journal of Laws of 2015, item 29)5) Act of 21 December 2000, on the commercial quality of agri-food products (Journal of Laws of 2019, item 2178)2. The foodstuffs listed should be delivered in original, factory sealed packaging, without physical signs and traces of damage, with information and markings on the packaging formulated in Polish3. Each unit packet of foodstuffs must have a label containing details provided for in the applicable regulations, as well as a Certificate of Hazard Analysis and Critical Control Point (HACCP) System, the manufacturer or a Certificate on the introduction and application of the HACCP system, issued by the implementing unit and a confirmation of the implementation of the HACCP system issued by the Chief Sanitary Inspectorate.4 The contractor shall deliver the ordered batch of foodstuffs each time within 3 working days from the date of placing the order by the Ordering Party's representative5. Delivery will be made on working days from Monday to Friday from 8.00 to 14.00 after informing the Ordering Party by fax or e-mail about the planned delivery date. The Purchaser may refuse to accept the delivery if it takes place after 2 p.m. - regardless of the reasons for delaying the delivery.6 The subject of the contract will be unloaded by the Contractor in the room indicated by the Purchaser.7 The Contractor is obliged to deliver the subject of the contract free from physical and legal defects and not violating the rights of third parties.8 The costs of delivery and unloading in the place indicated by the Purchaser shall be borne by the Contractor and do not constitute grounds for additional charges to the Contractor.9 In the case of late delivery, the Purchaser reserves the right not to take it back without any consequences.10The Purchaser shall appoint persons to collect the delivered foodstuffs on the day of delivery.11. Any incorrect, damaged or defective goods shall be returned to the Contractor, which shall be confirmed on a complaint report.12The Ordering Party reserves the right to complain about improper quality of foodstuffs (mechanical damage, short shelf-life, etc.) within 10 days from the date of receipt of the defective goods, and the Supplier must replace the improper quality of foodstuffs within 10 days from the date of receipt of the complaint.13. The Supplier will be obliged to collect pallets from the delivery, unless it indicates in the delivery documents that the pallets become the property of RZGW in Cracow free of charge.
