Due to the existence of industrial property rights with regard to the active ingredient covered by the contract, the participation and contract documents will only be made available to pharmaceutical companies that offer/commercialize drugs for the active ingredient covered by the contract. The present announcement does not concern the award of a public contract within the meaning of the Public Procurement Directive (2014/24/EC) or the Antitrust Procurement Act (Kartellvergaberechts). In the interest of providing interested pharmaceutical companies with the broadest possible information, this notice is published in the Supplement to the Official Journal of the European Union. The procedural designation "Open Procedure" in accordance with Section IV.1.1) and the indication of the award criteria in accordance with Section II.2.5) used in the present notice text are owed to the specifications of the notice form and have no further meaning. Herewith as well as with the use of the medium "TED" no submission is connected under procurement law regulations, whose validity is not obligatorily given by law and/or award regulations.
