A detailed description of the subject of the contract, i.e. quantity, required minimum technical, qualitative and functional parameters, as well as the conditions necessary to be fulfilled, have been specified in Appendix No. 1 to the ToR.General requirements for the subject matter of the order: a) must meet the requirements for admission to trading and use, b) must have legally required approvals and approvals in accordance with applicable regulations, c) must be brand new, unregenerated, unused, not being an exhibit at the fair, originally packaged and manufactured no later than 12 months before the delivery date, d) must meet the requirements imposed by law for admission to trading in Poland, have valid documents and registration certificates required by law in accordance with the Act of 20.5.2010 on medical devices (i.e. Journal of Laws 2019) item 175, as amended), e) it must be free from physical and legal defects, in particular it must not infringe any rights of third parties, f) it must be complete, and to its start-up and use, in accordance with its intended use, it will not be necessary to purchase additional elements or accessories, g) it must be characterized by all technical and operational parameters required by the Ordering Party and described in Appendix No. 1 to the ToR.The Ordering Party requires that the offered subject of the order: a) be covered by the manufacturer's/supplier's warranty specified in Appendix No. 1 to the ToR, with the minimum required warranty period being 48 months; b) be provided with authorized warranty service for at least 48 months and post-warranty service for at least 10 years provided by an authorized representative of the Manufacturer in Poland; c) be provided with the availability of spare parts for at least one year; d) be provided with the availability of spare parts for at least one year. The Contractor shall also be obliged to: a) ensure transport of the subject of the order to the Customer's registered office in such a way as to meet the conditions imposed in this respect by the manufacturer; b) unload, assemble and start up the delivered equipment at the registered office of the Customer, at the place and time indicated by him; c) deliver, together with the delivery of the equipment, detailed operating and maintenance instructions and warranty cards, as well as a list of authorized service points providing services during the warranty and post-warranty period and a list of suppliers of special spare parts, consumable parts or consumable materials specified by the manufacturer of the product. All the above-mentioned documents shall be provided in the Polish language version; d) training of the Ordering Party's personnel, on site, in the scope of operation and use of equipment, also in the scope of technical and service. The training must be confirmed by a protocol and should take place in time to enable the training of all the Employer's staff working in shifts. The Employer requires the Contractors to pay a deposit of: Part No. 1. 1 500,00 PLN Detailed requirements for the deposit are described in point. THIRTEENTH. All the above-mentioned documents shall be provided in the Polish language version. d) training of the Ordering Party's personnel, on site, in the scope of operation and use of equipment, including technical and service. The training must be confirmed by a protocol and should take place in time to enable training of all the Employer's personnel working in shifts. The Employer requires the Contractors to pay a deposit in the amount of: Part No. 2. 9900,00 PLN Detailed requirements for the deposit are described in point. THIRTEENTH.
