Description

The subject matter of the contract is the provision of domestic and international postal services consisting of the Contractor's collection, acceptance, movement and delivery of unregistered and registered letter mail, and in the event of an inability to deliver it, its return to the Ordering Entities.In order to carry out the subject matter of the contract, the Contractor should have at its disposal Postal Outlets in the number of at least 322 in Poland, including at least 10 Postal Outlets in each province, meeting the minimum requirements specified in § 8 of the Draft Contractual Provisions, constituting Appendix No. 11 to the SWZ.
(1) The subject matter of the contract is the provision of domestic and international postal services consisting in the collection, acceptance, movement and delivery by the Contractor of unregistered and registered letter mail, and in the event that delivery is not possible, their return to the Ordering Entities.In order to carry out the subject matter of the contract, the Contractor should have at its disposal Postal Outlets in the number of a minimum of 322 in Poland, including at least 10 Postal Outlets in each province, meeting the minimum requirements specified in § 8 of the Draft Contract Provisions, constituting Appendix No. 11 to the SWZ. Requirements for employment on the basis of a labor contract:2. The Employer requires employment on the basis of labor contracts by the contractor or subcontractor, respectively, of persons performing activities that, in the opinion of the Employer, consist in the performance of work as specified in Article 22 § 1 of the Act of June 26, 1974. - Labor Code (i.e., Journal of Laws of 2022, item 1510) with at least the minimum wage referred to in the Act of October 10, 2002 on the minimum wage (i.e., Journal of Laws of 2020, item 2207) and the Ordinance of the Council of Ministers of September 13, 2022 on the amount of the minimum wage for work and the amount of the minimum hourly rate in 2023 (Journal of Laws of 2020, item 2207).2.1 The activities specified above include the activities of:a) delivery of letter mail, advising delivery of letter mail - letter carriers,b) issuance of letter mail - employees of postal outlets,c) sorting of letter mail - employees of mail sorting centers.The requirement specified in lit. (b) does not apply to the activities of issuing Parcels carried out by persons who do not have to be employed under a contract of employment, as long as this results from separate regulations.The requirement in letter (c) does not apply to the activities of sorting Parcels carried out by persons , who do not have to be employed under a contract of employment, as long as this results from separate regulations.2.2 The requirements for verification of the obligation of employment under a labor contract and the sanctions for this are specified in the Draft provisions of the contract attached as Appendix No. 11 to the SWZ.
