The subject matter of the contract is granting a long-term bank loan in the amount of PLN 10,000,000.00 (in words: ten million 00/100) for financing the planned budget deficit in accordance with Resolution No. 616/LVII/2023 of the County Council of Radom dated August 11, 2023.2 Documents in electronic version, specifying the legal, financial and investment situation of the Employer and OPZ constitute Annex No. 8 to the SWZ.
The subject matter of the contract is granting a long-term bank loan in the amount of PLN 10,000,000.00 (in words: ten million 00/100) for financing the planned budget deficit in accordance with Resolution No. 616/LVII/2023 of the Radom County Council dated August 11, 20232. The Ordering Party shall repay the loan in 20 principal installments of PLN 500,000.00 (in words: five hundred thousand 00/100).3. The loan installments shall be repaid in accordance with the loan repayment schedule on a quarterly basis by the last day of the second calendar month of each quarter, with the first installment to be repaid by 29.02.2024, and the last installment will be repaid by 30.11.2028.4. The loan will be disbursed in one tranche based on the Ordering Party's instruction from November 23, 2023. 5.The final actual date of use of the loan: December 15, 2023.6. The date of repayment of the loan installment shall be the date of debiting the Ordering Party's bank account.7. The legal security for the repayment of the loan shall be a blank promissory note together with a promissory note declaration countersigned by the County Treasurer.8. For the purpose of price calculation only, it is assumed that the loan will be disbursed in one tranche on November 27, 2023, WIBOR 1M rate as of August 10, 2023 of 6.83% and the actual number of days, i.e. 365/366.9. Interest on the amount of the loan used will be paid on a monthly basis, within 7 days from the date of receipt of the original notice from the Contractor containing the relevant calculation according to the WIBOR 1M rate on the last day of the month preceding the period for which interest is calculated and increased by the bank's fixed margin. In the event of liquidation of the WIBOR 1M rate, it will be changed to a rate that will replace the WIBOR 1M rate or to a rate most similar in size and nature to the WIBOR 1M rate.10. The loan interest rate will be calculated only on the amount of the loan actually used. In case of repayment of the loan at an earlier date, interest will be calculated until the date of actual repayment, not until the end of the contract. 11. the Ordering Party reserves the possibility of early repayment of loan installments.12. the Contractor will make the final settlement of the repayments made on the date of repayment of the last installment of the loan principal and bank interest.13. the Contractor will not charge a preparatory commission and any fees and commissions: 1) for granting and disbursing the loan, 2) for processing the application, 3) for changing the loan repayment schedule, 4) for an annex to the agreement, 5) for early repayment of the loan or extension of the loan term, 6) for opening and operating a bank account for the loan.14. The Contracting Authority reserves the right to refuse to complete documents (forms, analytical statements, etc.) received from Contractors regarding the financial and investment situation of the Radom District.
