Time of completion: 29.08.2022 (northeast) / 13.10.2022 (remainder)Security for the fulfillment of the contract is to be provided in the amount of 5.0 percent of the contract sum (incl. sales tax, without supplements), provided that the contract sum amounts to at least 250,000 euros without sales tax.The security to be provided for claims for defects is 3.0 percent of the settlement sum (incl. sales tax) including supplements issued. Return date for a security for defect claims that has not been realized (§ 17 para. 8 no. 2 VOB/B): 4 yearsContractual penalties (§ 11 VOB/B)The Contractor shall be liable for a contractual penalty of 5.0 per cent of the contract sum stated in the order letter, excluding value added tax, in the event that the stated individual deadlines or the deadline for completion are exceeded; amounts for maintenance services offered shall not be taken into account. The reference figure for calculating the contractual penalty in the event that individual deadlines agreed as contractual deadlines are exceeded shall be that part of this order sum which corresponds to the services to be performed under the contract up to that point in time.
