§ 1. Subject of the services: Insurance contract for Operating Liability/Legal Protection and Medical Liability for the Centre Hospitalier Régional Sambre et Meuse (CHRSM) 1. This contract is a contract for insurance services, which fall under CPV code 660000-0. The purpose of the contract is to award the following insurance components:- Component 1: Operating liability and legal protection insurance for the Hospital- Component 2: Professional liability insurance for doctors (medical liability) for the CHRSMThe technical requirements to be met by the services are set out in the technical clauses of the special specifications.2. There is no division into lots. Tenderers will therefore have to submit offers for the two above-mentioned parts.Justification: In accordance with Article 58 of the law of 17 June 2016 on public contracts, the contracting authority has chosen not to divide the contract into separate lots. Indeed, the daily experience of the contracting authority demonstrates how important it is to manage liability coverage and claims jointly and centrally, both for reasons of administrative efficiency (multiple providers complicate the management of files) but also and above all to ensure maximum speed in the distribution of interventions of the respective contracts in the event of a claim, with the aim of appeasing the patients who have suffered damage. Such efficiency and purpose could, de facto, be prevented if the Hospital's insurer were different from that of the Doctors. For this reason, the contracting authority has decided not to proceed with an allotment. § 2 Important clarification: It is already specified that only insurance companies approved by the National Bank of Belgium, for one or more branches of insurance covered by this contract under the Act of 13 March 2016 on the status and supervision of insurance or reinsurance companies will be selected under this contract. Applications submitted by or with insurance brokers or other insurance intermediaries will be excluded, as the adjudicator has already appointed its insurance broker after a separate procedure in the person of DEGAUQUIER AND PARTNERS (FSMA No. 45523A).
