Description
The number of suppliers to be "monitored" is estimated at 2500. This figure is subject to change.This access is not limited to a simple consultation, it will be requested:- to contact our current suppliers (2500) to collect all the mandatory documents, as well as those indicated in Annex 1 CCTP;- to inform our current suppliers (2500) of this new tool and its use;- to check all the mandatory documents for our current suppliers but also each time a new listing is made;- carry out the necessary reminders and an interface, a "gateway" between the "Purchasing Authority's Purchasing" IS and the supplier compliance platform;- provide reports and user guides for the tool for users and suppliers;- set up the security of the beneficiary's data;- provide for backups, storage, restorations;- set up reversibility.
The law on the obligation of vigilance, including the fight against undeclared work, requires each company to check certain points of compliance of its suppliers every six months during the contractual period; this obligation also applies to subcontracting. The suppliers concerned are those to whom a company pays invoices of at least EUR 5,000 excluding VAT per year.In particular, the Kbis extract: document certifying the legal existence of the supplier; the attestation of vigilance: document certifying that the supplier is up to date with its obligations in terms of declarations and payments of social security contributions and social contributions (CSG/CRDS and, where appropriate, the vocational training contribution (CFP)) and the Nominative list of non-EU foreign workers (LNTE) employed by the supplier; or, failing this, an attestation of non-employment of non-EU foreign workers.In addition to these documents, a verification of the RIBs will be requested from the future provider as well as the management of other additional documents (List of documents in Annex 1 of the CCTP)In this context of law, it seems useful to also refer to the Sapin 2 Law: law on transparency, the fight against corruption and the modernisation of economic life, which aims to bring French legislation up to the best European and international standards in the fight against corruption, and thus contribute to a positive image of France on the international scene. The draft law was adopted by the Parliament on 8.11.2016 and definitively validated by the Constitutional Council on 8.12.2016. As a principal, each company is jointly and severally liable to its suppliers in the civil, financial and criminal senses. It is in this legal context that Vilogia and the members of the consortium would like to subscribe to the provision of compliance monitoring services via a platform mentioned in the subject matter of the contract.The execution of this contract is subject to the technical conditions described and detailed in the Special Conditions of Contract (CCTP) and its annexes, which precisely define all the services to be provided. The contractor and the beneficiary will work in partnership to achieve the objectives defined for this contract. The contractor will have to adapt all the elements mentioned to the specificities of the members of the group.
