The subject matter of the contract is the provision by the Contractor to the Contracting Authority of a comprehensive supply of gaseous fuel in the form of high-methane natural gas (group E), consisting in the sale of gaseous fuel and provision of its distribution service, to installations located in the Contracting Authority's facilities, hereinafter referred to as offtake points, a list of which is attached as Annex 2 to the ToR.2 The total quantity of gaseous fuel to be supplied during the term of the contract to the offtake points specified in Annex 2 to the ToR is estimated at 50 796 020 kWh.
The subject matter of the contract is the provision by the Contractor to the Contracting Authority of a comprehensive supply of gaseous fuel in the form of high-methane natural gas (group E), consisting in the sale of gaseous fuel and provision of its distribution service, to installations located in the Contracting Authority's facilities, hereinafter referred to as offtake points, a list of which is attached as Annex 2 to To ToR 2.The total quantity of gaseous fuel to be delivered during the term of the contract to the offtake points specified in Annex 2 to the ToR is estimated at 50,796,020 kWh.3 The volume of gaseous fuel specified in item 2 is an estimated value based on past consumption. The Contracting Authority reserves the right to reduce or increase the total volume of gaseous fuel in relation to the quantity specified in item 2. During the term of the agreement, the Contractor will supply gaseous fuel in the amount corresponding to the actual demand of the Contracting Authority regardless of the estimated consumption forecast. The Contractor shall not be entitled to any claim on account of the Purchaser's failure to take the anticipated amount of gaseous fuel. A possible change in the estimated consumption specified in item 2 will not result in additional costs for the Contracting Authority, apart from the settlement for the actual amount of gaseous fuel used.4. The order for gaseous fuel in particular gas months and the order for contractual capacity are specified in Appendix No. 2 to To ToR 5.Comprehensive delivery of gaseous fuel will take place under the conditions specified in the Energy Law Act of 10 April 1997 (consolidated text in Journal of Laws of 2020, item 833, as amended), hereinafter referred to as the "Energy Law Act", and in executive acts issued on its basis, with specific quality standards.6 Quality standards referred to in Article 91 clause 2a:6.1. in accordance with the Regulation of the Minister of Energy of 24 September 2018. (Journal of Laws of 2018, item 1814) amending the Regulation on detailed conditions for the operation of the gas system. The quality standards are specified in particular in Chapter 8 of the Regulation: "6.2. rebates for failure to meet the quality standards of customer service and rebates for failure to meet the quality parameters of gaseous fuels, in accordance with the tariff of DSO Polska Spółka Gazownictwa Sp. z o.o. z o.o. with its registered office in Warsaw, approved by the President of the Energy Regulatory Office on 18 March 2020 by decision no. DRG.DRG-2.4212.51.2019.AIK;6.3. discounts for failure to meet the quality standards of customer service in accordance with the Tariff of the Contractor.7The service of distribution of gaseous fuel to the off-take points will be provided through the distribution network belonging to the local DSO - Polska Spółka Gazownictwa Sp. z o.o. with its seat in Warsaw.8The Contracting Authority shall grant a power of attorney to the Contractor selected in the procedure to:8.1. terminate the existing comprehensive gas fuel supply agreements or submit a declaration on the termination of comprehensive gas fuel supply agreements by mutual agreement of the parties;8.2. submit on behalf of the Contracting Authority a comprehensive gas fuel supply agreement to the distribution system operator in order to execute the concluded comprehensive gas fuel supply agreement;8.3. perform all actions and arrangements with the DSO and the existing supplier necessary to carry out the supplier switching procedure and effectively start the comprehensive gas fuel supply.
