Description

1 The subject of the contract is successive delivery within 12 months (from 1.1.2021 to 31.12.2021) of liquid fuels in the minimum quantity: - diesel (ON) - 550,000 litres, - unleaded petrol (Pb95) - 150,000 litres. 2. the quantity of fuels indicated in point 1 is the minimum quantity. The Ordering Party reserves the right of option, i.e. during the term of the contract for the purchase of larger quantities of fuels (up to 40 % of the value of the basic order), depending on the demand resulting from difficult to predict market conditions. The maximum quantity of fuels, taking into account the right of option, is set at: - diesel - 770,000 litres, - unleaded petrol - 210,000 litres.
The subject of the order is successive delivery within 12 months (from 1.1.2021 to 31.12.2021) of liquid fuels in the minimum quantity:
- diesel fuel (ON) - 550,000 litres,
- unleaded petrol (Pb95) - 150 000 litres.
2. the quantity of fuels indicated in point 1 is the minimum quantity. The Ordering Party reserves the right of option, i.e. during the term of the contract for the purchase of larger quantities of fuels (up to 40 % of the value of the basic order) depending on the demand resulting from difficult to predict market conditions. The maximum quantity of fuels, taking into account the right of option, is set at:
- Diesel oil - 770 000 litres
- unleaded petrol - 210 000 litres.
3. the purchaser will place orders as required. The size of disposable fuel deliveries is foreseen in the range:
- Diesel oil - from 10,000 to 30,000 litres,
- unleaded petrol - from 3 thousand to 10 thousand litres.
4) Fuels should meet the quality requirements appropriate for the given fuel, specified
In the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws 2015.1680)
The Contractor shall deliver fuel throughout the term of the agreement in batches on the next working day from the moment of receiving the demand by fax or electronic means to the petrol station belonging to PK Sp. z o.o. located in Bielsko Podlaskie at 37 Studziwodzka Street.
6. deliveries will be made on working days from Monday to Friday, excluding public holidays.
7th The Contractor undertakes to carry out the subject of the order with its own means of transport (tankers).
The tankers shall meet the requirements set out in the Act of 19 August 2011 on the transport of dangerous goods (Journal of Laws 2020.154 I.e.).
Unloading of fuels at the Ordering Party's site will be carried out by the Contractor at his expense.
The Contractor should attach to each delivery, before unloading, a current quality certificate or laboratory certificate for a given batch of fuel issued by an authorised specialist laboratory together with a proof of issue (transport document) containing the name of the product and its manufacturer.
(11) If the Ordering Party finds that the quality of the delivered fuel is inconsistent with the presented quality certificate, the Contractor shall immediately, at its own expense, replace it and cover all costs of repairing the damage resulting from this.
(12) The maximum quantities of fuel specified in point 2 shall be used to calculate the offer price, while the final quantity of fuel delivered shall result from the actual deliveries made.
The Contractor is obliged to carry out the order on the terms and conditions described in the specimen agreement constituting Appendix 5 to the ToR.
(14) The Awarding Entity holds a license to trade in fuels covered by this order, issued by the President of the Energy Regulatory Office. The subject matter of the activity covered by the concession is business activity in the scope of trade in liquid fuels marked with CN codes:
14.1 diesel oil (CN: 2710 19 43, CN: 2710 20 11);
14.2 unleaded petrol (CN: 2710 12 45, CN: 2710 12 49).
(15) The orderer informs that:
15.1 the fuel purchased shall be used by the Principal for his own account and shall be offered for resale in accordance with the Principal's concession;
15.2 does not trade in liquid fuels with foreign countries;
15.3 the Ordering Party's tanks and measuring devices have and shall have valid legalizations during the execution of the order.
