Description

Part 1 Performing forestry services in the Corniact Forestry. A detailed description of the works included in the subject matter of the contract is included in Annex 3, respectively, which consists of the material scopes listed in Annex 3.1.-3.3. A detailed description of the technology of performing individual forest works included in the subject of the contract is included in Annex 4 to the ToR. Descriptions of activity codes describing individual works included in the subject matter of the order are described in Annex 4 to the ToR. A description of the procedure for the acceptance of works is included in Annex 5 to the ToR. The Economic Operator may submit a tender for one or more parts. A tender submitted for a particular section must cover the entire scope of work provided for in the ToR for that section. The location (forest address) of individual forest works within the scope of the Agreement is preliminary. The location (forest address) of particular works within the scope of the subject of the Agreement shall be specified in the Order referred to in 3.3.1), provided that it will always be the Execution Area of the Part. Due to the actual natural and weather situation that may occur during the execution of the subject matter of the contract, as well as the currently unforeseen economic situation, the Contracting Authority reserves the right to make reducing adjustments, increasing adjustments, determining new locations, as well as to stop performing the activities indicated in individual lines of the tables describing the subject matter of the contract. Incremental adjustments shall not mean the introduction of new work not covered by the scope of the basic contract, and decreasing adjustments shall not mean the total abandonment of part of the work. It should be understood as an increase in the number of works in one location (forest address) on the Part Execution Area (Package) (including the locations on the Part Execution Area (Package) not initially indicated in the ToR), while reducing the number of works in another location (forest address) on the Part Execution Area, within the total number of individual works falling within the scope of the subject of the Agreement specified in the ToR, to be performed in the whole Part Execution Area. It may also be necessary to increase the size of some elements of the contract in the course of execution of the subject matter of the contract in order to execute the full scope of works described in the subject matter of the contract. The new location shall be determined within the subject of the order, always exclusively in the Part Execution Area. For lubrication of cutting systems in exploited chainsaws and cutting heads the Contractor will be obliged to use biodegradable oil with the biodegradation parameter not worse than 60%. It is required to determine biodegradability in accordance with the test methodology described in Commission Regulation (EC) No 440/2008 of 30 May 2008 in the method: OECD 301B or OECD 301C or OECD 301F laying down test methods pursuant to Regulation (EC) No 1907/2006 of the European Parliament and of the Council on the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH). The purchaser shall require that lumberjacks of petrol chainsaw operators use bio-oil to lubricate the cutting chains. Tractors and dumper trailers fitted with a crane must have up-to-date surveillance tests in accordance with the Law of 21 December 2000 on technical surveillance. The Contracting Authority shall require that the Contractor's employees and other persons acting on behalf of the Contractor (e.g. a subcontractor) use the personal protective equipment required (health and safety manual) at a given workstation.The subject matter of the contract shall be made with the use of technical conditions for the wood raw material in accordance with Ordinance No. 51 of 30 September 2019 on the introduction of technical conditions for trade in wood raw material at the State Forest Enterprise or equivalent. Detailed description of the works included in the subject of the contract is included in Appendix no. 3, which consists of the material scopes listed in Appendix no. 3.1.-3.3. The new location shall be determined within the subject of the order, always exclusively in the Part Execution Area. Tractors and machinery must have current surveillance tests in accordance with the Law of 21 December 2000 on technical surveillance. The Contracting Authority requires that the Contractor's employees and other persons acting on behalf of the Contractor (e.g. a subcontractor) use the personal protective equipment required (health and safety instructions) for the workstation. The Contractor shall be obliged to clean up the remains of work from roads, surface division lines, ditches, etc. and other waste from its own activities (rubbish, empty packaging, used machine elements, etc.). The Contractor is obliged to equip all machines, tractors and devices working on forest areas with appropriate sets (sorbents, sorption mats, etc.) to absorb spilled fuel or oil and other technological fluids used in machines, tractors and other devices working in the forest, and to use these means in situations requiring application (breakdowns, repairs, refuelling, etc.) in order to prevent environmental contamination. Tractors and machines must have a current survey of the technical supervision in accordance with the Technical Supervision Act of 21 December 2000. The Contracting Authority requires the Contractor's employees and other persons acting on behalf of the Contractor (e.g. subcontractors) to use the personal protective equipment required (health and safety instructions) at a given workstation. The Contractor shall be obliged to clean up the remains of work from roads, surface division lines, ditches, etc. and other waste from its own activities (rubbish, empty packaging, used machine elements, etc.).
