The subject of the contract are forest management services as defined in Article 6(1)(1) of the Forest Act of 28 September 1991 (i.e.: Dz. U. of 2017, Dz, The material scope of the subject matter of the contract covers the total amount of timber harvesting and skidding work resulting from the attachment to the contract, i.e. the total amount of timber harvesting and skidding work, as well as the total amount of timber harvesting and skidding work. no. 3 to the ToR, which consists of attachment no. 3.1 for package 6/2019 - size of works according to activities, attachment no. 3.2 for package 6/2019 - difficulty zone and distance of skidding and attachment no. 3.3 for package 6/2019 - assortment system of wood harvesting. A detailed description of works (activities) included in the subject of the contract is included in Appendix 3, respectively. The material scope of works (activities) listed in Appendix 3.1-3.3 is an estimate. A detailed description of the technology of performing particular forest works (activities) included in the subject of the contract is included in Attachment No. 4 to the ToR. Descriptions of activity codes describing individual works (activities) included in the subject of the contract have been described in Attachment No. 4 to the ToR. The rules of the procedure for acceptance of works have been included in Attachment No. 5 to the ToR. A Contractor may submit an offer for one or more Packages. The offer submitted for a given Package must, however, cover the entire scope of works provided for in the ToR for this Package. Implementation of works included in the subject of the contract for particular Packages will take place in the area of forestry - appropriate for a given Package. Due to the actual natural and weather conditions, which may occur during the execution of the subject of the contract, as well as unforeseen economic and economic situation, the Contracting Authority reserves the right to make downward corrections, increasing corrections, findings of new locations, as well as to suspend the activities indicated in the individual rows of tables describing the subject of the contract. Increasing corrections do not mean the introduction of new works not covered by the scope of the main contract, and decreasing corrections do not mean the total abandonment of part of the works. It should be understood as an increase in the number of works in one location, at the cost of reducing the number of works in another location - within the total number of works. Corrections will apply to works performed in the area appropriate for works included in the description of the subject matter of the contract concerning a given part. The need to increase the size of certain elements of the contract in the course of performance of the subject matter of the contract may also occur in order to complete the full scope of works described in the subject matter of the contract. Determination of the new location shall take place as part of the subject matter of the contract. In case of obligatory exclusion of items from harvesting in the machine system (harvesting of wood in cutting positions where the use of multi-purpose machines is not allowed) in particularly justified cases, e.g. change of conditions for which the above activities have been determined, the Contracting Authority shall allow for a change in the technology of wood harvesting. The justification should be presented to the Contractor each time. The Contracting Authority shall require that the contractor or subcontractor employ, on the basis of an employment contract, persons performing the activities included in the subject matter of the contract involving the harvesting and extraction of wood, if the performance of these activities consists in performing work in the manner specified in Art. 22 § 1 of the Act - Labor Code.
