Description

The subject of the contract is forest management services as defined in Article 6(1)(1) of the Act of 28.9.1991 on forests (consolidated text: Dz.U. of 2017, item 788 as amended) covering works in the scope of breeding and forest protection, fire protection, timber harvesting and skidding, tourist forest management, to be performed in the Smolarz Forest Inspectorate in the years 2020-2021 in the following Forestry Departments: Ługi, Czarny Las, Górzyska, Smolarz.The total size of all types of services included in the subject matter of the contract is as follows:Manual work on forest management in 55 834 nh Manual work on forest management in 3 532 h Manual work on fences in 18 458 nh Manual work on fences in 2 542 h Mechanical work on forest management in 1 400 h Mechanical work on forest management 860 hPmechanical work in fencing 428 hPmechanical work in shredding 1,082 nhPmechanical work in logging 102,912 nh and hPmechanical work in logging and logging 320 hPmechanical work in logging 8,000 nhPeasurement of the workload is estimated. The number of works commissioned to be performed during the performance of the Agreement may be lower than the number specified in the ToR, which, however, may not be the basis for any claims against the Ordering Party. The amounts indicated in the logging sorting system included in the ToR are based on stock survey estimates, and the actual size of work commissioned to the Contractor in this respect may differ up to 25% from the scope indicated in the logging sorting system included in the ToR, which shall not be the basis for any claims of the Contractor against the Contracting Authority.Due to the actual natural and weather situation, which may occur during the execution of the subject of the contract, as well as the unforeseen economic and financial situation, the Contracting Authority reserves the right to make downward corrections, increasing corrections, new location arrangements, as well as suspension of activities indicated in the individual rows of tables describing the subject of the contract. Increasing adjustments do not imply the introduction of new works not included in the scope of the base contract, and decreasing adjustments do not imply a total resignation from part of the works. They should be understood as an increase in the quantity of works in one location at the cost of reducing the quantity of works in another location - within the gross value of the subject matter of the contract. Corrections will concern works performed in the area appropriate for works included in the description of the subject of the contract concerning a given part. The Contracting Authority requires the Contractor or a subcontractor to employ, on the basis of an employment contract, persons performing the activities included in the subject matter of the contract consisting in the acquisition and extraction of wood, if the performance of these activities involves the performance of work in the manner specified in Article 22 § 1 of the Act of 26 June 1974. - Labour Code (consolidated text: Journal of Laws of 2018, item 917, as amended) The Contractor may entrust the implementation of elements (parts) of the subject of the contract to subcontractors. The number of works commissioned to be performed during the performance of the Agreement may be lower than the number specified in the ToR, which, however, may not be the basis for any claims against the Ordering Party. Due to the actual natural and weather situation that may occur during the performance of the contract, as well as the unforeseen economic and financial situation, the Contracting Authority reserves the right to make downward adjustments, increase or suspend the performance of selected activities. Increasing adjustments do not imply the introduction of new works not included in the scope of the base contract, and decreasing adjustments do not imply a total resignation from part of the works. They should be understood as an increase in the quantity of works in one location at the cost of reducing the quantity of works in another location - within the gross value of the subject matter of the contract. Corrections will concern works performed in the area appropriate for works included in the description of the subject of the contract concerning a given part. The Ordering Party requires that the Contractor or a subcontractor employ, under an employment contract, persons performing activities included in the subject matter of the contract consisting in performing mechanical (tractor) works, if the performance of these activities involves performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974. - The Contractor may entrust the implementation of the elements (parts) of the subject of the contract to subcontractors. The Contracting Authority has at its disposal nursery machines and equipment which will be made available to the Contractor against payment (upon its written request), to whom the contract for Package 4 will be awarded. The detailed conditions of making them available are included in the model contract for the lease of nursery equipment (attachment No. 16 to the ToR).
