The subject of the contract is the following services for elevators and elevator shaft smoke extraction systems- Inspection and maintenance- Functional testing for SHEV systems / elevator shaft smoke extraction systems- Expert testing- Testing of electrical systems and equipment in accordance with DGUV- Emergency call acceptance and personal rescue---The tendered service is divided into three lots.
The following services- Inspection and maintenance- Functional test for the SHEV systems / elevator shaft smoke extraction systems- Expert tests- Testing of electrical systems and equipment in accordance with DGUV- Emergency call acceptance and passenger rescue are to be carried out on the following systems:Passenger elevator: 11 units (different manufacturers and different drive types)Facade elevator: 1 unitPassenger/freight elevator: 1 unitPassenger/freight elevator: 1 unitGreight elevator underfloor: 1 unitFreight elevator: 1 unit---.Services of the Contractor (Contractor)The Contractor shall provide or deliver all equipment, tools and auxiliary materials (e.g. measuring and testing equipment), materials and auxiliary materials (e.g. cleaning agents, sealants, lubricants and corrosion protection agents) as well as also suitable access technology (e.g. ladders, working platforms) and protective equipment etc. required for the performance of the services, as well as all other auxiliary materials and equipment, etc. not explicitly mentioned. Unless otherwise specified, the costs are included in the unit prices.Inspection, Maintenance and TestingThe Services shall include at least all regular measures to maintain the proper condition and function of the conveying and other technical systems and their facilities and equipment, which are necessary to determine and assess the actual condition (inspection), to delay the reduction of the existing wear stock (maintenance) and at least in accordance with the manufacturer's work instructions.The inspection, maintenance and testing shall be carried out at least in accordance with the manufacturer's specifications and in accordance with all valid and relevant laws, regulations, standards, guidelines, etc., as well as the recognized rules of technology. The Contractor shall perform all necessary services in a timely and professional manner.-The Contractor shall carry out the inspection and maintenance of the technical systems and their facilities and equipment in accordance with the special agreements (work cards, manufacturer's specifications). The description of the services or the work to be performed (work cards, bill of quantities, etc.) are only exemplary and not complete. The actual or possibly additionally required work may deviate from this and depends, among other things, on the respective condition and service life of the system.-The inspection, maintenance and testing services also include:- the removal of all operational contamination from central facilities and equipment as well as in the operating rooms and lift shafts.- the removal of all operational contamination from central facilities and equipment as well as in the operating rooms and lift shafts.- the removal of all operational contamination from central facilities and equipment as well as in the operating rooms and lift shafts. the operator's obligations under the Ordinance on Industrial Safety and Health (BetrSichV)-- § 10 BetrSichV with regard to maintaining the plant in proper condition in accordance with regulations, repair (if commissioned) and maintenance, shutdown if defects that endanger employees or third parties are detected during maintenance-- § 16 BetrSichV with regard to arranging and documenting periodic inspections-- § 19 BetrSichV with regard to notifying the responsible authority in the event of an accident or damage. All letters to the supervisory authorities and/or monitoring bodies shall be sent to the Client simultaneously as a copy/copy.- the provision of the necessary manpower for the legally prescribed tests.-- load weights shall be provided by the Contractor.- As far as permissible, an approved electronic testing system may be used for the tests at the Contractor's expense instead of providing load weights. if marked as a price field in the contract, the testing of all electrical system parts of the conveyor system(s) incl. shaft and operating room installations and the documentation of results in accordance with Regulation 4 of the German Social Accident Insurance (DGUV V4) (at least once in 4 years depending on the last test).- if marked as a price field in the contract, the performance of the recurring expert tests.The Contractor shall independently organize all prescribed tests. Depending on the regulations or requirements, the Contractor undertakes to have the tests carried out by a competent person [approved inspection body (ZÜS) or expert]. This also includes the entire coordination, organization and compilation of all documents and data required for the inspection as well as the personnel support of the expert by a technician who is familiar with the site and the plant. All fees and costs incurred in connection with the tests shall be borne by the Contractor. The Contractor shall accompany the approved inspection body (ZÜS) during the performance of the tests. The Contractor shall, at the request of the Purchaser, instruct the Purchaser's technical personnel (elevator attendants/qualified persons) in the operation of the conveyor systems. The instruction has to take place within the scope of the maintenance, so that no additional costs for the journey etc. arise. All fees and costs incurred in connection with the instruction shall be borne by the Contractor. If faults, defects and/or damage are detected during inspection, maintenance and/or testing, the Principal shall be informed without delay.- The Contractor shall be obliged - also outside the regular maintenance dates - to eliminate faults which impair plant safety or endanger the use of the building upon the Principal's request.- The Contractor shall be obliged to inform the Principal of any faults, defects and/or damage which are detected during inspection, maintenance and/or testing, the Principal shall be informed without delay.In the case of defective parts of the conveying and other technical systems or in the case of fault reports by the Principal, the Contractor shall submit a quotation for the repair, including delivery of parts, within 5 working days of being requested to do so and shall perform these services within 14 working days of being separately commissioned by the Principal. These services shall be remunerated separately. There shall be no legal entitlement to commissioning of the repair work. Emergency call acceptanceAn emergency call from the car shall be accepted by a permanently manned emergency call center of the Contractor at least in accordance with DIN EN 81-28, if marked as a price field in the contract, and shall arrange for the rescue measures. Telephone connection costs and ongoing telephone charges shall be borne by the customer.The execution of the service emergency call module for rent (see contract) includes in particular:- Delivery and assembly- Connection and commissioning- Emergency call system- GSM module with active SIM card- Maintenance and inspection- Dismantling after termination- Release measuresThe release measures shall be carried out by the Contractor.The time from the emergency call to the arrival of the person providing assistance at the system and the initiation of the release of persons shall be carried out in accordance with TRBS 3121 (operation of elevator systems) within 30 minutes, on any day and at any time.--.Obligations of the ContractorAll obligations of the Contractor under this contract shall apply equally to subcontractors engaged by the Contractor. The Contractor shall therefore be obliged to inform subcontractors of all provisions of this Contract and to oblige them accordingly vis-à-vis the Client. The Contractor shall perform the services in such a way that the safety of the conveying and other technical equipment is maintained. The operational readiness is to be maintained for the duration of the services as far as this is possible.-The generally accepted rules of technology, the state of the art, the statutory provisions, the relevant DIN, DIN-EN standards, guidelines and protective regulations, in particular the Ordinance on Industrial Safety and Health, the Act on Installations Requiring Surveillance (ÜAnlG) and accident prevention regulations, etc. are to be observed.-The Contractor is to perform the services with his business. He may transfer parts of the service to subcontractors with the prior consent of the AG. Certification as a maintenance company in accordance with DIN EN 13015 must be available.-The Contractor is obliged to use competent and reliable personnel to perform the contractually specified services. For the service to be provided, the personnel employed must have the qualification "qualified person in accordance with § 3 DGUV - Regulation 4 or an equivalent qualification or the qualification as an electrician in accordance with DIN EN 50110-1 (VDE105-100)" furthermore, the personnel employed must have at least the qualification for elevator systems in accordance with BetrSichV and TRBS 3121 (authorized person for elevator systems).The personnel must have sufficient command of the German language for the provision of the contractual service. If the Contractor detects faults which could endanger the operational readiness or safety of the conveying or other technical systems, it shall notify the Principal without delay and, if necessary, arrange for the shutdown of the conveying or other technical systems in the event of imminent danger.-It shall confirm communications by telephone or verbally in text form. The Contractor shall immediately notify the Purchaser in writing of other faults which must be eliminated and the elimination of which is not part of the agreed services.-If the Contractor recognizes that other agreements to this contract will become necessary due to changes in use or changes in the existing regulations, he shall notify the Purchaser of this in text form.-The Contractor shall provide the necessary equipment for fault clearance and fault analyses (specific software, tools, etc.) for the systems.
