1.1 The subject of this order is a comprehensive supply of electricity (supply of electricity together with distribution service) to the facilities listed in Annex 1 to the ToR - description of the subject of the order The demand for electricity in the period from 01.01.2020 to 31.12.2021 amounts to: 1 818 492 kWh (change in the amount of energy during the contract period +/- 545 548 kWh).1.2. The detailed scope of the contract was specified in Appendix 1 to the ToR, pursuant to the provisions of the Energy Law Act of 10 April 1997. The remaining terms and conditions of the contract are specified in the material provisions of the contract - in Section 14 of the ToR.1.3. - Energy Law and in accordance with the implementing regulations issued to this Act, in particular with the customer service quality standards set forth in the Regulation of the Minister of Energy of 6 March 2019 on detailed rules for shaping and calculating tariffs and settlements in electricity trade and the Regulation of the Minister of Economy of 21 August 2008 on detailed conditions for the operation of the power system. The above provisions concern the manner of calculation, settlements and quality parameters of the electricity supplied.1.4 Requirements for the Contractor: The Contracting Authority will grant the power of attorney to the selected Contractor in the proceedings up to:1.4.1.Representing the Contracting Authority in contacts with the existing Seller of electricity or Distribution System Operator in matters related to the process of changing the Seller concerns the points set forth in Annex 1 to Agreement No. 1.5. During the performance of the contract, the Ordering Party reserves the right to reduce or increase the total amount of electricity and the distribution value of the purchased electricity within the scope up to ± 30% of the amount of electricity (distribution value) specified in Appendix 1 to the ToR. If the circumstances referred to above occur, the Contractor's remuneration due under this agreement shall be reduced or increased accordingly. Under this right, the Purchaser may add and subtract energy consumption points. In case of adding and subtracting energy consumption points and changing energy distribution parameters, the Contracting Authority shall submit a written declaration of intent to the Contractor concerning the exercise of the above right in the scope specified by the Contractor. If the Contracting Authority does not exercise the right to reduce or increase the total amount of energy and the value of distribution of the purchased electricity within the scope of up to ± 30 % in relation to the amount of the Contractor, the Contracting Authority shall not be entitled to any claims on this account. The total value of the changes described above shall not exceed 30% of the value of the comprehensive agreement to be concluded with the Economic Operator selected in this procedure.
