Description

The subject of this order is the supply of electricity to the facilities listed in Appendix 1 to the ToR - description of the subject of the order The demand for electricity in the period from 1 January 2020 to 31 December 2021 amounts to: 8 612 252 kWh (base load contract) 11 195 929 kWh (with 30 % option right). Subject Hydrophornia, address: Ducks Medium, 62-700 Turek, No. ppe PL0037460004622383 has a photovoltaic installation installed, data on technical parameters and consumption are described in Appendix 1A to the ToR - data on microinstallation. The facility has concluded separate agreements for the sale of electricity (repurchase) with the term of validity until 31.12.2019 and for the supply of electricity with the term of validity until 31.12.2019. The repurchase agreement is not subject to PPL regulations. An agreement shall be concluded with the Contractor selected in this procedure, the subject of which shall be the sale of electricity generated in the Facility and introduced to the DSO distribution network in accordance with the applicable regulations. Settlements resulting from imbalance of electricity supplied and received from the system for a given point of consumption (PPE) are performed by only one POB.2. The detailed scope of the order is specified in Appendix No. 1 to the ToR, pursuant to the provisions of the Energy Law Act of 10 April 1997. The remaining terms and conditions of the contract are specified in the draft contract for the sale of electricity - Attachment No. 2 to the ToR.3. The supply of electricity will take place under the terms and conditions specified in the Act of 10 April 1997. - Energy Law and in accordance with the executive regulations issued to this Act, in particular with the customer service quality standards set forth in the Regulation of the Minister of Energy of 6 March 2019 on detailed rules for shaping and calculating tariffs and settlements in electricity trading. The quality parameters of electricity in the distribution part are regulated by the Ordinance of the Minister of Economy of 4 May 2007 on detailed conditions for the operation of the power system.4 Distribution services will be provided on the basis of a separate agreement concluded by the Ordering Party with the appropriate Distribution System Operator (DSO) - the DSO data is included in Appendix No. 2 to the ToR. The reserve seller is Energa Obrót SA.5. Obligations for the Contractor are described in the draft sales contract attached as Appendix No. 2 to the ToR.6.The existing agreements for the sale of electricity with existing electricity suppliers for electricity points included in Attachment No. 1 to the ToR are concluded for a definite and indefinite period of time, and a detailed description for each of the PPE points is included in the column entitled "Contract duration / notice period".7 In Attachment No. 1 to the ToR, the parameters (tariff group, capacities) that may differ from those currently in force or may be subject to change during the term of the electricity contract are indicated informally.8During the performance of the contract, the Contracting Authority reserves the right to reduce or increase the total amount of purchased energy to ± 30% of the basic order specified in Appendix 1 to the ToR. If the circumstances referred to above occur, the Contractor's remuneration due under this agreement shall be reduced or increased accordingly. Any increase or decrease in the amount of electricity shall not give rise to any claims on the part of the Contractor.
