The subject matter of the contract is the supply of electricity within the meaning of the Act of 10 April 1997 - Energy Law (consolidated text: Journal of Laws of 2021, item 716, hereinafter referred to as "Energy Law") to the Ordering Party's facilities for a period of 12 months from 1 January 2023. 1.
The subject matter of the contract is the supply of electricity within the meaning of the Act of 10 April 1997 - Energy Law (consolidated text: Journal of Laws of 2021, item 716, hereinafter referred to as the Energy Law) to the Contracting Authority's facilities for a period of 12 months from 1 January 2023. 2. A detailed description of the subject matter of the contract is included in Appendix No. 1 to the SWZ. The Contracting Authority informs that the planned electricity consumption is 11,985 MWh (+/- 10%) for the period of 12 months from January 1, 2023. The Contractor should take into account fluctuations in electricity consumption at the level of (+/- 10%).3. electricity should meet the technical parameters in accordance with the provisions of the Energy Law, implementing acts to the Energy Law. 4 Contract type: supply. The list of energy consumption points covered by the proceedings is enclosed as Attachment No. 1, Table No. 2 to the SWZ. CPV code: 09310000 electricity, heat, solar and nuclear energy. 6. The Customer is not an excise tax payer on the purchased energy, so the price should include excise tax. 7. 7) The Contracting Authority has regulated the division of contracts for the distribution and supply of electricity. 8) The Contracting Authority does not have comprehensive agreements concluded for the EPP covered by the proceedings. 9) Only the Contracting Authority holds the legal title to all EPP, to which energy is supplied (there are no external entities). 10) The Contracting Authority obliges the Contractor to provide the energy required for the supply of electricity. The Contracting Authority obliges the Contractor to provide in the offer net and gross energy prices for individual tariff groups. 11. The Contracting Authority informs that the current contract for the supply of electricity for all energy consumption points expires on 31.12.2022.12. The Contracting Authority declares that it has valid distribution agreements for all energy consumption points and they are concluded for an indefinite period.13. The Distribution System Operator for all energy consumption points is Tauron Dystrybucja S.A. - Branch in Gliwice. The Contractor shall be obliged to conclude an agreement with the distribution system operator, to which the Ordering Party's facilities are connected, enabling the sale of electricity to these facilities via the distribution network belonging to Tauron Dystrybucja S.A. 31-358 Kraków, ul. Jasnogórska 11; Tauron Dystrybucja S.A. Gliwice Branch 44-100 Gliwice, ul. Portowa 14a.14. The Contracting Authority has energy billing measurement systems adapted to changing the Contractor.15. The Contracting Authority has not conducted preliminary market consultations in the meaning of Art. 84 of the Public Procurement Law prior to commencing the procedure for the award of a contract.16.The Contracting Authority declares that it will provide in electronic form all the necessary data for the supplier switching procedure.18. The Contractor, on the basis of the granted Power of Attorney will carry out (after concluding the energy sales contract - Appendix no. 4 to the SWZ) the notification of energy consumption points based on the data provided by the Ordering Party for the purpose of supplier switching.19. - Energy Law, as amended. - 19. The Contracting Authority hereby informs that according to art. 9g par. 6b of the Energy Law of 10 April 1997, as amended, it is necessary that one and the same entity responsible for trade balancing (POB) is indicated for one EPP, both for the direction of electricity consumption and introduction to the network of the Distribution System Operator. The Contractor undertakes, after conclusion of the Agreement for the sale of electricity in the direction - energy consumption, to conclude an agreement for the sale of electricity produced from a Renewable Energy Source with a validity period from 01.01.2023 to 31.12.2023. The Contracting Authority declares that it is registered in the register MIOZE/URE/00533/2018 on 17.07.2018.
