Type of contract: in accordance with Art. 2, 20o of the Law, the present contract is a public supply contract.Subject of the contract: public supply contract for the supply, installation, maintenance and management of lighting fittings (including the DALI bus system) and emergency lighting (including its monitoring system) for a period of ten years (see technical clauses for detailed description). The successful tenderer retains ownership of the installed lighting fittings and emergency lighting for the entire duration of the contract, with transfer of ownership taking place at the time of acceptance of the contract (see Art. III.2.6).The present contract is constructed as a leasing of the lighting fittings and emergency lighting with transfer of ownership, free of charge, at the end of the contract. The ten-year term starts to run from the commissioning of the installations (see Article III.2.1).The duration of the contract is justified by the AP's desire to adopt a responsible purchasing approach:- by promoting the installation of high-quality, durable lighting systems, the installation of which requires a sufficient amortisation period for both the AP and the successful tenderer;- by taking into account as many elements as possible in the life cycle costs of the equipment;- guaranteeing the durability of the equipment by involving the installer, the owner of the lighting, lighting fittings and emergency lighting, in preventive and reactive maintenance until the end of the contract, thus encouraging him to install equipment that is easy to maintain and replaceable piece by piece;- offering the AP the possibility of easily upgrading its installation according to requirements;- ...Site:The project is installed in buildings A, A', B, C and C' located along the boulevard Général-Jacques as well as in building M in the centre of the Usquare site.It is part of an overall renovation, restoration and transformation project for these buildings for which the award procedure is underway. The coordination between this lighting contract and the main works contract is ensured, for the study and execution phases, by the general contractor that will be appointed.Obligation of result: the tenderer, in his tender, undertakes an obligation of result, i.e. he provides for everything that is useful to satisfy the execution of the contract and to achieve the results defined in the present CSCh.In the absence of contractual technical specifications, the services must comply in all respects with the rules of the trade.If a product presented in the tender is no longer available at the time of its order, the tenderer undertakes to deliver a product which is at least technically equivalent and under the same contractual conditions.before it delivers, the tenderer shall submit this new product in writing to the contracting authority for approval.the tenderer shall also be responsible for all adaptations which may become necessary as a result of the adoption of new legislative standards in this field.
