Description

The health insurance funds (whether HEK/hkk participate in the respective lot is indicated in the name of the respective lot) pursue the goal of concluding rebate contracts with all suitable pharmaceutical companies in accordance with Section 130a (8) of the German Social Code, Book V (SGB V) for the named active ingredients, combinations of active ingredients or dosage forms, and strengths of active ingredients. The contract is concluded within the framework of the open house procedure: individual negotiations on the content of the contract are not conducted; uniform conditions apply. The health insurers do not guarantee exclusivity to individual contract partners. The contract term is a maximum of 24 months, beginning no earlier than May 1, 2022 (any different start times for HEK and hkk are specified in the information for the corresponding lot). The contract ends on 30.04.2024 at the latest (for possible exceptions, please refer to the information provided for the corresponding lot), regardless of the date on which the contract was concluded. Joining this open house procedure is possible at any time during the contract period. All further information can be found in the participation and contract documents.
The non-exclusive discount agreements concluded in the open house procedure of the health insurance funds serve in principle to bridge the period between patent expiry of active ingredients, active ingredient combinations or dosage forms, active strengths and the entry into force of exclusive discount agreements in accordance with Section 130a (8) of the German Social Code Book V. It is possible to join this open house procedure at any time during the term of the agreement. A contract will be concluded with all pharmaceutical companies that meet the requirements of the self-declaration on approval and reliability contained in the procedure documents and confirm this in text form in accordance with Section 126b of the German Civil Code (BGB). This announcement does not relate to the award of a public contract within the meaning of the Public Procurement Directive (2014/24/EC) or antitrust law. In the interest of providing the broadest possible information to interested pharmaceutical companies, this notice is published in the Supplement to the Official Journal of the European Union. The procedure designation "Open Procedure" (Section IV.1.1)) and the specification of the award criteria (Section II.2.5)) used in the context of the present notice text are owed to the specifications of the notice form and have no further meaning. This and the use of the medium "TED" do not imply any submission to procurement law regulations, the application of which is not mandatory by law or procurement regulations.
