The subject of this publication is the conclusion of non-exclusive discount agreements pursuant to Section 130a (8) SGB V for drugs containing the active ingredient fampridine (ATC: N07XX07) within the framework of a so-called "open-house model". All suitable and interested pharmaceutical companies or associations of pharmaceutical companies are offered the opportunity to conclude or join a rebate contract in accordance with Section 130a (8) of the German Social Code, Book V for the active ingredients listed in Section B, subject to uniform contract conditions and a uniform access procedure. Interested pharmaceutical companies can request the participation documents and the respective contract from the contact address mentioned under I.1). A prerequisite for the conclusion of an agreement is that the interested pharmaceutical company submits the requested participation documents completely filled out and signed.
Conclusion of non-exclusive discount agreements in accordance with Section 130a (8) of the German Social Code, Book V for drugs containing the active ingredient fampridine (ATC: N07XX07) with the option to conclude agreements at any time as part of a so-called "open-house model". A contract is concluded with each pharmaceutical company that meets the participation requirements. There is no exclusivity and the contract can be concluded at any time and under the same conditions. Individual contract negotiations are not carried out. The earliest start date of the contract is 01.06.2022. Based on this, the maximum contract period is 24 months. The contract ends on 31.05.2024 regardless of the start of the contract. Should AOK Saxony-Anhalt invite tenders for exclusive contracts for the active ingredients during the term of the contract in accordance with the relevant provisions of public procurement law, the contracts concluded in the context of this publication shall be terminated in accordance with the contractual provisions.This publication does not constitute the award of a public contract within the meaning of Section 103 GWB or public procurement law. In order to ensure the greatest possible degree of transparency for the intended contract conclusions, the publication is made in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice is used. The resulting conceptual specifications, such as the procedural designation "open procedure", are solely due to the use of this publication form and the publication platform. Any further meaning, in particular a submission to procurement law regulations, insofar as they are not obligatory for legal reasons, is not associated with this.
