The subject of this publication is the conclusion of agreements pursuant to Section 130a (8) of the German Social Code, Book V (SGB V) on various active ingredients/drug combinations as part of a so-called open house procedure. For details, see the respective lot.
The subject of this publication is the conclusion of agreements in accordance with Section 130a (8) of the German Social Code, Book V on various active ingredients/drug combinations as part of a so-called open house procedure. Under the specification of uniform contract conditions as well as a uniform access procedure, all suitable and interested pharmaceutical companies or communities of pharmaceutical companies are offered the conclusion of or access to a rebate contract pursuant to Section 130a (8) SGB V for the named active ingredient/drug combination. Interested pharmaceutical companies can, after registration, download the order documents (participation documents and contract) at: https://www.dtvp.de/Satellite/notice/documents. The e-mail address specified under Section I: Public contracting authority, point 1.3.) Communication for the purpose of unrestricted and complete access to the order documents free of charge is not valid. Information can be obtained exclusively via your registration on the "DTVP" procurement platform under the communication tab. Information and answers from other sources are not binding. A prerequisite for the conclusion of a contract is that the interested pharmaceutical company submits the required procedural documents completely filled out and signed. Each pharmaceutical company that fulfills the participation requirements and documents this by signing the declarations and the rebate contract can join the rebate contract. There is no exclusivity. The accession or the conclusion of the contract can take place at any time and under the same conditions. Individual contract negotiations are not carried out. The start of the contract can only be the first day of a month. The earliest start of the contract is 01.08.2023. Based on this, the contract term is a maximum of 24 months. The contract ends on 31.07.2025 at the latest, irrespective of the date on which the contract is concluded. The offer must be received by 23.06.2023 at the latest for the start of the contract on 01.08.2023; however, no contracts will be concluded by AOK Nordost before 04.07.2023. For a later contract start date, the deadline for submission of offers is the 5th of the respective previous month. (Example: contract start date 01.09.2023; deadline for submission of the offer: 05.08.2023).Should AOK Nordost award an exclusive contract for the active ingredient(s)/active ingredient combination(s) in an open procedure during the contract term, the contractual provisions concluded in the context of this publication shall apply. This publication does not constitute the award of a public contract within the meaning of the Procurement Coordination Directive 2014/24/EU of the European Parliament and of the Council or public procurement law. In order to ensure the greatest possible degree of transparency for the intended contract conclusions, the publication is made in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, this form of contract notice is used. The resulting conceptual specifications, such as the procedure designation open procedure, are solely due to the use of this publication form and the publication platform. This does not imply any further significance, in particular a submission to public procurement law regulations, unless they are obligatory for legal reasons.
