Conclusion of a non-exclusive discount agreement in accordance with Section 130a (8) of the German Social Code, Book V on drugs containing the active ingredient lanthanum(III) carbonate (ATC code: V03AE03) within the period from July 1, 2022 to June 30, 2024 with the option of concluding the agreement at any time during the term ("open-house model").The contracting parties can be viewed at: https://www.aok-gesundheitspartner.de/nds/arzneimittel/rabatt/index_03504.html?bl=nds
For the active ingredient lanthanum(III) carbonate (ATC code: V03AE03), AOK Niedersachsen. Gesundheitskasse offers discount contracts to all interested pharmaceutical companies, without a selection decision, for the period until exclusive contracts come into force as a result of a formal award procedure in accordance with the regulations of Part 4 of the GWB. The contracts are concluded within the framework of an "open-house model" and act as a bridge between the start of generic competition (patent expiry) and the award of exclusive contracts. The contracts offered are not exclusive; contracts with all market participants (pharmaceutical companies) are desired by the AOK Lower Saxony. In the open-house model, uniform conditions apply to all participants. Contract contents, conditions and access procedures are uniform - individual negotiations are generally not conducted. The contract terms are a maximum of twenty-four months, the earliest contract start date is 01.07.2022. All contracts end on 30.06.2024 at the latest, regardless of the date of the respective contract conclusion. Within the twenty-four-month period, a member may join or conclude a contract on the first day of each month. There is a right of termination six weeks to the end of each month. The AOK Lower Saxony. Gesundheitskasse reserves the right to replace non-exclusive open-house discount contracts with exclusive discount contracts already during the term of the contract. When advertised, exclusive discount contracts come into force, the open-house contracts are terminated in accordance with the contractual regulations, i.e. the open-house contracts end automatically. According to the experience of the AOK Lower Saxony, exclusive rebate contracts usually come into force six to eight months after publication of the corresponding tender notice in the Supplement to the Official Journal of the European Union. The future contract partners in the open-house model are requested to inform themselves regularly about these tender notices in the Supplement to the Official Journal of the European Union.Interested pharmaceutical companies can request the contract documents as well as the contract conditions at the contact address mentioned under I.1).Contracts for the active ingredient lanthanum(III) carbonate (ATC code: V03AE03) will be concluded for the first time with effect from July 1, 2022. Interested parties wishing to become contract partners on this date must submit the contract documents to be submitted by 27.05.2022 to the address stated in the contract documents. The date of receipt by the AOK Lower Saxony is decisive. Later contract conclusions are possible during the twenty-four-month maximum term on the first of each month. Organizationally, a lead time of usually 35 calendar days is necessary on the part of the AOK in order to be able to guarantee the necessary work, e.g. the contract registration in the Lauer-Taxe®. The exact deadlines for receipt will be announced with the contract documents. This publication does not constitute the award of a public contract within the meaning of Directive(2014/24/EU) or public procurement law. In order to ensure the greatest possible degree of transparency for the intended contract conclusions, the publication is made in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice is used. The resulting conceptual specifications, such as the procedural designation "open procedure", are solely due to the use of this publication form and the publication platform. A further meaning, in particular a subjection to subcontracting regulations, as far as they are not obligatory for legal reasons, is not connected with it.
