Conclusion of non-exclusive discount contracts in accordance with Section 130a (8) SGB V for drugs with the active ingredient timolol and bimatoprost (S01ED62) within the period from June 1, 2022 to May 31, 2024 with the option of concluding the contract at any time (open-house model).
The AOK Rhineland-Palatinate/Saarland - Die Gesundheitskasse offers discount contracts with the active ingredient timolol and bimatoprost (S01ED62) to all interested pharmaceutical companies without a selection decision. The contracts are concluded within the framework of an "open house model". The contracts offered are not exclusive; contracts with all market participants (pharmaceutical companies) are desired by the AOK Rhineland-Palatinate/Saarland - Die Gesundheitskasse. In the open house model, uniform conditions apply to all participants. Contract contents, conditions and access procedures are uniform - individual negotiations are not conducted. The contract terms are a maximum of 24 months, the earliest contract start date is 01.06.2022. All contracts end no later than 24 months after the date of the earliest contract start date, regardless of the date of the respective contract conclusion. Within the 24-month period, a customer may join or conclude a contract on the first day of any month. There is a right of termination six weeks to the end of each month in accordance with the provisions of the contract. AOK Rhineland-Palatinate/Saarland - Die Gesundheitskasse reserves the right to replace non-exclusive open house discount contracts with exclusive discount contracts during the term of the contract as part of a Europe-wide tendering process. With the entry into force of tendered, exclusive discount contracts, the open house contracts will be terminated in accordance with the contractual regulation, i.e. the open house contracts will end automatically. Interested pharmaceutical companies can request the participation documents as well as the contract documents from the contact address mentioned under I.1). Contracts for the active ingredient timolol and bimatoprost (S01ED62) will be concluded for the first time with effect from 01.06.2022. Interested parties who wish to become contract partners on this date must submit the contract documents to be submitted to the AOK Rhineland-Palatinate/Saarland - Die Gesundheitskasse by April 30, 2022. The date of receipt by AOK Rheinland-Pfalz/Saarland - Die Gesundheitskasse is decisive. Note: The first contract award in this procedure will be made no earlier than 10 calendar days after publication of this EU notice in the Official Journal. Subsequent contracts may be concluded on the first of each month during the twenty-four-month maximum term. In the case of interested parties wishing to become contract partners on these subsequent dates, receipt of the contract documents, including Annex 1, must be submitted no later than the end of the month preceding the month of the desired contract start date (e.g., receipt on April 30 for a contract start date of June 1). The exact deadlines for receipt will be announced with the contract documents. This publication does not constitute the award of a public contract within the meaning of the Public Procurement Coordination Directive 2014/24/EU of the European Parliament and of the Council or public procurement law. In order to ensure the greatest possible degree of transparency for the intended contract conclusions, the publication is made in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice is used. The resulting conceptual specifications, such as the procedure designation "open procedure", are solely due to the use of this publication form and the publication platform. Any further meaning, in particular a submission to procurement law regulations, unless they are mandatory for legal reasons, is not associated with this.
