3.1 The subject matter of the contract is successive delivery of dressing materials and specialist dressings to a closed pharmacy, to the place indicated by the Purchaser. A detailed list of the assortment is presented in Appendix No. 2 attached to the SWZ, CPV code: 33141110-4 Dressings.3.2 Details required for sterile products shall be placed on the packaging and shall include:a) Expiry date) Serial numberib) Product description3.3 The order has been divided into 8 sets (parts).

The kit should include all the items listed. Failure to fill in any of the items within a set will result in rejection of the offer.3.5. The subject matter of the order shall be new, manufactured no earlier than 2022, The subject matter of the order shall be new, manufactured not earlier than 2022, admitted to trading pursuant to the applicable law and meet all requirements defined by law, in particular the Act of 20 May 2010 on medical devices (Journal of Laws of 2021, item 1565) and be free from any physical or legal defects and have a shelf life of not less than 12 months on the date of delivery.3.6. If a trade name of a company, commodity or product is indicated in the tender documentation, the Contracting Authority shall accept equivalent solutions in accordance with the technical data and parameters contained in the documentation. If the Contracting Authority allows solutions equivalent to those described in the documentation attached to the SWZ, but does not provide the minimum parameters that would confirm the equivalence - the Contractor is obliged to offer a product with similar properties, functionally suitable for the required application (argument based on the ruling of the National Appeal Chamber of 14 October 2013 [KIO 2315/13]). The Contractor who invokes equivalent solutions described by the Contracting Authority is obliged to prove that the supplies offered by him meet the requirements specified by the Contracting Authority. NOTE: A proper name is a name under which the object designated by it exists (or would exist) both in Poland and in other countries.3.9. Whenever trademarks, patents, origin, standards, approvals, technical specifications and technical reference systems are indicated in the description of the subject matter of a contract, the Contracting Authority shall allow for equivalent solutions. Equivalence consists in the possibility to offer the subject matter of the contract with no worse technical parameters, configurations, normative requirements, etc.3.10. Information on prior evaluation of tenders pursuant to art. 139 PPL. The selection of the most advantageous offer will be made using the so-called "reverse procedure". The Contracting Authority shall first examine and evaluate the tenders and then qualify the economic operators whose tenders were evaluated most favourably with respect to absence of grounds for exclusion and meeting the conditions for participation in the procedure.
